Vice President Jagdeep Dhankhar has expressed displeasure over the Supreme Court set up the deadline for the President and the governors to approve the bills. He said that we cannot keep a situation where the courts should direct the President of India. He said that the court found under Article 142 of the Constitution has become a 24×7 available nuclear missile against democratic powers.
Under Article 142, the Supreme Court of India can give any order, instruction or decision to perform complete justice (complete justice), whether it is in any case. Vice President Jagdeep Dhankhar said that India had not imagined such democracy, where the judges would enact the law, handle the executive themselves and act as a super parliament.
Last week, the Supreme Court first determined that the President should take a decision within three months from the date of receiving reference on the bills reserved by the Governor. The Vice President said, “The President has been instructed in a recent decision. Where are we going? What is happening in the country? We have to be very sensitive. This is not a question of filing or not doing a review. We did not deal with democracy for this day. The President is being asked to decide in a time -bound manner and if it does not, then the respective bill becomes law.
The Vice President said, “The post of President in India is very high and the President takes an oath of defense, protection and rescue of the Constitution, while others including the minister, Vice President, MPs and Judges take an oath to follow the Constitution. We cannot make a situation where you can direct the President of India and on what basis you have to explain the constitution under the constitution?”
Addressing the 6th batch trainees of the Rajya Sabha, the Vice President said, “I mention the recent events. They are dominated by our minds. An incident happened at the residence of a judge in New Delhi on the night of 14 and 15 March. No one knew about it for seven days. We would have to ask questions to ourselves. What is the delay is not able to understand?” Is it not a great question?
Emphasizing the division of powers, Vice President Jagdeep Dhankhar said, “The executive, government, people are elected. The government is accountable to Parliament, the government is accountable to the people in the election. The principle of accountability is there in operation. You can ask important questions in Parliament because the government is from the executive.”
