On the statement of Bharatiya Janata Party (BJP) MP Nishikant Dubey, the Supreme Court has appealed to maintain the dignity and prestige of the institution. However, the Supreme Court did not directly mention Nishikant Dubey’s statement. He made the remarks on Monday (April 21, 2025) when an MP was informed that an MP had made a remark against the Chief Justice.
Petitioner and Advocate Vishal Tiwari sought permission to withdraw his PIL filed for hate speeches during the violence in Murshidabad, West Bengal on the Waqf Amendment Act. At that time Vishal Tiwari informed the bench of Justice Suryakant and Justice N. Kotishwar Singh about this incident.
Vishal Tiwari was referring to the statements of BJP MP Nishikant Dubey, who said that if the Supreme Court has to enact a law, then Parliament and Legislative Assembly should be closed. The bench told Vishal Tiwari, ‘We should maintain the dignity and prestige of the institution even in the allegations. In Article 32 (under writ) petition, the statements given should also be respectable.
The court allowed Vishal Tiwari to amend his petition and asked him to bring something concrete in the Supreme Court. BJP distanced distance from Nishikant Dubey’s comments on the Supreme Court and on April 19, party president JP Nadda described these comments as his personal views. Vishal Tiwari said in his petition that there was violence in Murshidabad district of West Bengal and North 24 Parganas in protest against the Waqf Amendment Act and many people died and property was damaged.
The petition said, ‘This can be a good opportunity for some people for some people and some parties use religious sentiments to get political benefits. Instead of maintaining peace, political leaders give inflammatory speeches, which causes the situation to worsen. In the petition, the Supreme Court’s order of 21 October 2022 has been cited, in which his authorities were directed to initiate action against those who gave hatred speeches.
He said, “No action has been taken against the Chief Ministers, Ministers and Political Leaders in constitutional positions,” he said. Vishal Tiwari had requested to direct the formation of a five -member judicial inquiry commission headed by a retired judge of the Supreme Court to investigate the violent protests against the Waqf Amendment Act in Murshidabad district of West Bengal.
In the petition, the Government of Bengal was also requested to take action against any community and individual and instruct him to curb them on hatred and inflammatory speeches.
