Impeachment Motion Against Gyanesh Kumar: The Rajya Sabha Chairman has refused to accept the notice given by 63 Rajya Sabha MPs for the removal of Chief Election Commissioner (CEC) Gyanesh Kumar. Along with this, the Speaker of the Lok Sabha has also rejected this proposal. This decision has been taken under Section 3 of the Judges (Inquiry) Act, 1968.
The notice of the impeachment motion, which was signed by 193 MPs (130 from the Lok Sabha and 63 from the Rajya Sabha), was submitted to the Rajya Sabha Chairman on 12 March 2026. This was the first such attempt in Parliament against any Chief Election Commissioner after the country’s independence.

The notice was given under the provisions of Article 324(5) and Article 124(4) of the Constitution as well as the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023 and Judges (Inquiry) Act, 1968. Opposition MPs had accused Gyanesh Kumar of biased conduct, irregularities in the Special Intensive Review (SIR) of voter lists and other allegations.
The Chairman, after a detailed review of the notice and all aspects related to it, refused to accept it. He said that there is no basis for taking the proposal forward. Due to this the impeachment process has stopped.
What allegations did the opposition make?
Opposition parties have made seven allegations against Chief Election Commissioner (CEC) Gyanesh Kumar. These include serious allegations like ‘prejudicial and discriminatory conduct while in office’, ‘proven misconduct’, ‘deliberate obstruction in the investigation of electoral fraud’ and ‘large scale disenfranchisement’.
The opposition has raised questions over the manner of Special Intensive Revision (SIR) of the voter list, especially in Bihar. They allege that due to this process many voters were deprived of their rights. It has also been said in the allegations that the Chief Election Commissioner adopted a partisan attitude while working in favor of some political parties. According to sources, the opposition has also cited several decisions of the Supreme Court in support of these claims.
Derek O’Brien took aim
TMC MP Derek O’Brien wrote on X- ‘The petition by Rajya Sabha MPs to remove Chief Commissioner Gyanesh Kumar was rejected. Reason? No reason was given. BJP keeps making fun of our great Parliament. Shameful!’
He further wrote- ‘The proposal to remove the Chief Commissioner was presented in the Rajya Sabha on March 12. A separate petition was also presented in the Lok Sabha on the same issue. The Parliament lasted till 2 April. Both petitions were completely ignored in Parliament. What devious trick is the BJP now playing to save its Gyanesh Kumar?
