Justice Yashwant Verma Case: Allahabad High Court Judge Yashwant Verma resigned on April 10. He has submitted his resignation to Draupti Murmu. This step has been taken after a high profile cash scam and the ongoing impeachment proceedings against him. With his resignation a legal question has come to light. Can the police arrest him now? What will happen to his immunity after his resignation?
While working as a judge, Justice Verma had some constitutional protections. However, once his resignation is accepted, he will not get that exemption. Legally, they will be treated like any other common citizen. This means that investigating agencies can take action against them under ordinary criminal law.

Technically the resignation will end the impeachment process. Since the purpose of impeachment is to remove a sitting judge from office, his resignation before the process is completed makes the process meaningless. However, this does not mean that the allegations against him go away.
Can an FIR be registered against him?
After resignation, the police or agency can file an FIR. But this can happen only when they have some solid evidence. If the internal investigation or investigation report prima facie proves that he has committed corruption or has unaccounted cash, then an FIR can be registered and if necessary, he can also be arrested.
According to the historic Veeraswamy decision of the Supreme Court, an FIR cannot be registered against a sitting High Court judge unless the Chief Justice of India is consulted. However, after resignation, this security cover does not apply in the same way. Actually this matter is of March 2025. There was a fire at his official residence in Delhi. Burnt notes and a huge amount of cash were allegedly recovered during this incident. An internal committee of the Supreme Court had found him prima facie guilty. After this, 146 MPs started the impeachment process against him.
