After BJP getting unilateral majority in West Bengal, the entire state is looking saffron. It has been more than 24 hours since the election results were released, but BJP’s victory is still being celebrated in every street. The entire opposition including TMC is accusing the Election Commission of collusion in this victory of BJP.
Mamta refused to resign
TMC chief Mamata Banerjee on Tuesday (April 5, 2026) refused to resign from the post of Chief Minister and alleged that the result of West Bengal Assembly elections is not a mandate but a conspiracy. He refused to step down and said, ‘Why should I step down?’ we’re not broken. The mandate has been looted. Where does the question of resignation arise? I am not defeated, I will not go to Lok Bhawan. Banerjee alleged large-scale irregularities in vote counting, claiming that around 100 seats had been ‘looted’ and the pace of counting was deliberately slowed down to break the morale of her party.
Accused of assault at counting center
Mamata Banerjee also alleged that she was kicked, pushed and misbehaved inside the counting center yesterday. He claimed that the Central Force personnel were behaving like ‘goons’ outside the counting centres. Intensifying his attack on the Election Commission, he said, ‘A dark chapter has been written in history. The Chief Election Commissioner has become a villain.
According to constitutional experts, the situation of a Chief Minister refusing to step down after losing the election was never imagined before. Experts say that there is no such example in India when a defeated Chief Minister has refused to resign after losing the assembly elections. He said that if Mamata Banerjee remains firm on her stand, this could prove to be an unprecedented moment in the development of India’s parliamentary democracy.
What will happen next if Mamta does not step down?
Constitutional expert and former General Secretary of Lok Sabha PDT Acharya said that Mamata Banerjee will have to step down as soon as the new Chief Minister takes oath. He said, ‘There cannot be two Chief Ministers in one state. Mamata Banerjee was elected to the outgoing assembly and the term of the assembly is ending on May 7. According to constitutional provisions, the government is accountable to the legislature. When the term ends, the government also has to go.
Asked about the constitutional or legal options available to the West Bengal Governor after Mamata Banerjee’s statement, senior advocate and constitutional law expert Rakesh Dwivedi said that as per political morality and constitutional discipline, he should resign. He said, ‘Elections for the new assembly have been held and soon a BJP leader will stake claim for the post of Chief Minister and will be appointed Chief Minister by the Governor. If Banerjee does not resign, the Governor will dismiss her (Banerjee).
Mamta will have to resign: Expert
Senior advocate and former president of the Supreme Court Bar Association, Dushyant Dave, said, ‘The Governor should dismiss her (Mamata Banerjee).’ Senior advocate Ajit Sinha said that Banerjee should resign, otherwise she will step down after the new Chief Minister takes charge and proves majority in the House. He said, ‘Mamata Banerjee will have to resign. As per constitutional provisions, the Governor will have to call the majority party to form the government and prove majority in the House…After the new Chief Minister takes charge, it will be deemed that she has stepped down from the post.
When the 34-year rule of the Left Front ended in 2011, the then Chief Minister Buddhadeb Bhattacharya accepted defeat and immediately went to Raj Bhavan and submitted his resignation to Governor Gopal Krishna Gandhi. He stepped down without any delay, symbolizing an orderly democratic transition. Mamata Banerjee, who came to power that year on the strength of the anti-Left wave, presented herself as a grassroots worker-turned-administrator.

Political experts say that Mamata Banerjee’s growing closer to the Congress is a bit contradictory, because her party has earlier been critical of the Congress and its leaders, especially Rahul Gandhi, and there have often been differences of opinion between the two in many states like West Bengal and Tripura. Mamata Banerjee also announced the formation of a 10-member fact finding committee to visit the areas affected by the post-poll violence and assess the ground situation. He termed the allegations of violence after the elections in 2021 as baseless.
BJP rejected his claims outright and accused him of weakening democratic institutions and denying the public’s decision. Party spokesperson Debojit Sarkar said, ‘His comments cannot be accepted. She is just making herself a laughing stock. We feel that she is making such absurd comments to garner headlines for a few more days.
Election Commission rejected Mamta’s allegations
He also claimed that the Election Commission ensured peaceful voting and said that there was not a single incident of violence, firing or death during both the phases of voting. Meanwhile, the Election Commission rejected the Trinamool Congress chief’s allegations of ‘irregularities’ in Bhawanipur assembly constituency as ‘baseless and false’. Mamata Banerjee, contesting from this seat, lost to BJP leader Subhendu Adhikari by a margin of 15,105 votes and after this she raised questions on the election process and the role of the commission.
