Allahabad High Court news, The Allahabad High Court has said in a historic decision that after the father’s death, after the daughter getting a family pension, the benefit of the pension should be given to the younger sister living with her divorced mother. This directive was given by Justice Ajit Kumar during the hearing of the petition of Yachi Swati.
Case related to Meerut’s family
The petition was filed by Swati, a resident of Meerut. Swati’s father Gopal Krishna, the District Election Office, was working as a peon in Meerut and died on 15 March 2011. Swati’s parents were divorced in 2001. The father lived with his elder sister Charu, who was given family pension. While Yachi and his younger brother were living with mother. And the elder sister had got the job of the father, so she claimed for family pension.
Pension closed after Charu’s compassionate appointment
In the year 2013, Charu got a compassionate appointment to the post of junior clerk instead of father, after which his family pension was discontinued. Now Swati, who is unmarried and lives with her mother and younger brother, claimed to get this pension.
Mandate and court remarks
According to the state government’s mandate of 16 May 2015, unmarried daughters have been placed in the category of dependents for family pension. The government advocate also supported the investigation on this basis.
Decision in two months: Court
The court said that if there is no technical difficulty and the claim of the petitioner is found correct, then a family pension should be issued in its favor within two months. This decision is being considered a major step towards the protection of the rights of divorced women and their children.
