The Supreme Court has recently given an important message to the whole society, giving a historic verdict. The Supreme Court, while giving a verdict in a divorce case, made it clear that any women who are financially capable, they should try to become self -sufficient instead of asking their husbands for their living allowances. The court has said this especially about those cases of divorce, in which the couple has been married very short.
According to the report of the bar and bench, this remark of the Supreme Court came during the hearing of a high-profile alimony (Elimani) case. The woman involved in the case was an IT professional and also had an MBA degree. The woman was married only 18 months. The woman separated from her husband and demanded a large amount of 12 crore as alimony, an expensive apartment in Mumbai and an BMW car. The people present in the court were surprised to hear about this demand of the woman.
A bench of three judges including the Chief Justice heard the case
Hearing of this case in the Supreme Court, Chief Justice of India (CJI) BR Gawai, Justice K.K. Vinod Chandran and Justice NV. Anjaria’s three -judge bench did it. CJI BR Gavai also underlined her educational and professional background while commenting on the woman’s petition during the hearing of the case and said, “You are an IT professional. You have also done an MBA. Why do you not work if you have demand in cities like Bengaluru and Hyderabad?”
CJI raised questions on the woman’s petition
CJI Gawai commented on the property and alimony sought by the woman keeping in mind the short time of the couple’s marriage. He said, “This marriage lasted only 18 months and you are demanding one crore rupees for every month?”
CJI raised the question and said, “Is this right from anywhere, if someone wants a person of such a high standard, but without trying to make himself financially strong and self -sufficient without him?”
If the woman replied, the court gave two options
On the question of CJI, the woman replied in the court, saying that her husband is rich and had filed a petition to cancel the marriage on the basis of mental illness like schizophrenia. After hearing the woman’s answer, the court gave them two options. The court said, “Either he accept a flat free from any legal stake or make this agreement with a lump sum of 4 crores.”
According to the report of the bar and bench, the CJI reiterated his point and said to the woman, “You are educated. You should not depend on others. You should earn yourself and live your life with respect.”
