Prashant Kishor’s party Jansuraj has challenged the recently held Bihar Assembly elections in the Supreme Court. He filed a petition on Thursday (February 5, 2026), in which the Chief Minister of Bihar’s Women Employment Scheme has been specifically challenged. He says that during the implementation of the code of conduct, the government not only transferred Rs 10,000 to the accounts of 25-35 lakh women, but also added new beneficiaries to the scheme and this method is illegal. He has requested the court to direct the Election Commission to set a deadline of six months for the ruling party to start free and welfare schemes that can influence elections.
Jansuraj has filed a writ petition alleging illegal procedures in Bihar elections. The party especially challenged the Mukhyamantri Mahila Rozgar Yojana of the Bihar government and said that while implementing the code of conduct, Rs 10,000 were directly transferred to the accounts of women under the scheme. Voting for the assembly elections in the state took place on 6 and 11 November and the results were announced on 14 November.
The bench of Chief Justice Surya Kant and Justice Joymalya Bagchi will hear the petition on Friday. Jansuraj has filed a petition under Article 32. The petition demands that by implementing the code of conduct, transferring money to women’s accounts and adding new beneficiaries should be made illegal. He said that this is a violation of Articles 14, 21, 112, 202 and 324 of the Constitution.
In Jansuraj’s petition, it was said that the Election Commission should be directed to take action under Article 324 and Section 123 of the Representation of the People’s Act. The petitioner says that during Bihar elections, Rs 10,000 each were transferred to 25-35 lakh women voters. The petitioner also alleges that it is illegal to appoint 1.8 lakh women beneficiaries of the self-help group JEEVIKA at polling booths in both the phases of elections.
Citing an old order of the Supreme Court, the petitioner has appealed to it to conduct Bihar elections again and order the Election Commission to prepare guidelines for free schemes and direct benefit transfer scheme.
Jansuraj has also demanded that the Election Commission should set a time of at least six months for the announcement of free and welfare schemes for the ruling party, that is, these schemes can be announced six months before the elections. Bihar Chief Minister Mahila Rozgar Yojana was launched on September 26, 2025.
