Whose responsibility will be made
If it is proved that Chatgpt gave wrong, misleading or illegal content and Openai did not take appropriate steps to prevent it, then the responsibility will be completely of the company. In the US, there have been a fine of billions of dollars in cases of data privacy violations and user safety in the US.
In California, in the case of the case being filed against CHATGPT and proven the charge, it will be not the responsibility of the CEO or manager of the Openai company.
What are the rules in India
In India, if someone dies due to wrong or harmful information given by a company, then a criminal case can be run under the law. According to the Code of Justice of India (BNS), it depends on how the company gave information, whether it was deliberately fatal or was given carelessly.
If someone’s life is in danger due to the negligence or mistake of the company, then Section 125 of BNS can be put in danger of the lives or security of others. But if it is proved that someone dies directly due to the company’s information, even if there is no intention of murder, then Section 103 of BNS may apply to the murder.

In the US, if a company is sued and found guilty, then the punishment can be suffered not only to the company but also officers or employees like it. The company can be fined heavy as a punishment or may have to pay compensation of up to millions of dollars. On the other hand, if the direct responsibility of an officer or employee is proved, then they can also be sentenced to jail.
