‘Court cannot bind Governor and President within time limit’, SC said on presidential reference


On the Presidential Reference sent by President Draupadi Murmu under Article 143 of the Constitution, the Supreme Court has said that the court cannot set any time limit for the President and the Governor to take a decision on the bills. The court has also said that the Supreme Court cannot approve the bill on its own basis on the basis of delay in taking the decision by the Governor.

Giving its opinion on the Presidential Reference on Thursday (November 20, 2025), the Court said that under Article 200/201 of the Constitution, the Court cannot set a deadline for the Governor and the President to take a decision on the bill. He said that tying them to a time limit for taking a decision on the bill would be contrary to the spirit of the Constitution. The court said that there is a provision under Article 200 that the Governor can approve the bill, send it back to the Assembly or send it to the President, but if the Assembly sends back a bill, then the Governor has to approve it.
