Do grandchildren have the right on their grandparents’ property? What are the rules if it is a single girl child?

Whether grandchildren have the right on the property of their grandparents or not depends on some things. In this, it is important to first understand in which category the property of the maternal grandparents falls and who takes it forward. This decides whether you will get a share or not.

In India, grandparents’ property can be self-acquired or ancestral. The owner has full rights over the self-acquired property. He can give it to anyone as per his wish or can keep anyone out of it.

In such a case, the grandchildren do not get any legal rights on their own. If the property is ancestral then the rules are different. The rights in ancestral property are decided on the basis of the rights received from the family. But here also the rights of grandchildren come when their mother gives them the rights of her share.

This right does not go directly to the grandchildren. Now the question arises that if there is only one girl in the family i.e. a single girl child, then do she and her children get any extra rights. The law does not give any special exemption here also.

The rights of the daughter are equal but the rights of the grandchildren will be created only when the property comes to the daughter first. Whether the daughter is alone or has siblings. She does not become the direct heir to her parents’ self-acquired property.

This right is available only when the parents leave the property without leaving any will. Without a will, the daughter becomes the legal heir and the property is divided equally. If the grandparents want their property to go directly to the grandchildren. So for this they will have to make a will.
