Now if a former government employee, who is now working in a public sector undertaking (PSU), makes serious disturbances, then his earlier government job retirement pension can also be confiscated. The government has implemented this new provision by amending the Central Civil Services (Pension) Rules.
what the new rule says?
According to the notification issued by the Department of Pension and Pensioners Welfare (Doppw) on 22 May, if an employee is taken out from there due to wrong conduct or indiscipline after permanently absorbing a PSU, then the confiscation of pension benefits earned during government job can also be applicable on it. This decision will be taken after review of the Ministry concerned.
What was the rule before?
Earlier, if an employee was extracted while working in PSU, then pension and other retirement benefits related to his government jobs were not affected. It was clear under Rule 37 (29) (C) that disciplinary action in PSU would not affect the pension of government jobs. But now this rule has been changed to implement a new provision.
The change occurred after the order of the Supreme Court
This amendment has been done after the Supreme Court’s order of 9 January 2023. This order "Suraj Pratap Singh vs CMD BSNL" The case was given, in which clarity was sought on pension benefits. According to the instructions of the court, amending the rules, now the pension of a government job can be canceled even after being fired in PSU.
which employees will apply to this rule?

However, this decision will not be final. If an employee is extracted from PSU, then that decision will be reviewed by the concerned Ministry. That is, the decision to confiscate the pension will not be only PSU, but with the acceptance of the Ministry.
PSU employees will have to be more vigilant
From this new rule of the government, it is clear that former government employees working in PSU will now have to be more vigilant in their conduct and working style. Indiscipline or serious disturbance can now endanger not only the current job, but also the working pension received from the past years.
