Nimisha Priya, a resident of Kerala, has been found guilty of killing her business partner Talal Abdo Mahdi. The Yemen court sentenced him to death in this case in the year 2018. Nimisha was to be hanged today i.e. on July 16, but at the moment it has been postponed. His sentence was approved by Yemen’s President Rashad al-Alii in January this year. The Government of India is making every effort to save them. The Center has told the Supreme Court that blood money is the only way to save Nimisha Priya, who is serving a death sentence in Yemen. Such payment is allowed under the Sharia law prevalent in many Islamic countries. Let’s know how it works.

How blood money works in Sharia law

The spirit of revenge in Sharia law is based on a Sharia law named Qisas. Which means death sentence in return for death. In the case of murder, this means that the victim’s family can demand death as a punishment for the culprit. Blood money is also called in the Islamic Sharia law. For example, in murder or any other serious crime, the accused gives financial compensation to the victim’s family. According to the Sharia law, the murder takes place in two ways, one is intentional murder and the other is accidentally murdered. According to Sharia law, in the case of intentional murder, it is applied according to what is the punishment or how the crime has been punished.

If the murder is done by mistake, then according to the verse (4:92), the punishment is ransom i.e. blood money. But if the person who has died, his heirs forgive the punishment of their own will, then they are allowed to do so. In such a case, it is the duty of the killer to follow the fixed amount and pay it properly. According to scholars, the idea behind it is to promote forgiveness and the victim’s family has to give compensatory justice.

When did blood money work before

Earlier, the case of death on a criminal was removed, but after payment of Diya, he has been kept in jail. One such example is also a case of Abdul Rahim of Kerala. He was found guilty in Saudi Arabia due to the death of his employer’s son. Rahim was apologized by the victim’s family after paying a huge amount. However, even after this, his case was not closed and he was sentenced to 20 years in jail. Although he had been in jail in this case earlier too, his time was taken into consideration. The crime was committed in 2006 and was forgiven in 2018. Even after this, he was released next year.
