Addressing a public meeting in Ahmednagar, Maharashtra, AIMIM chief Asaduddin Owaisi targeted the central government over the notice issued under the Indian Civil Security Code (BNSS). He raised the question that when leaders of other opposition parties did not receive the BNSS notice, why was it given to me?” This statement has not only become a topic of discussion in political circles, but is also deepening the questions on the new criminal justice system.
Why this discrimination against me- Owaisi
This incident took place during the discussion on BNSS Amendment Bill in the Lok Sabha. Owaisi said in his 20-minute speech, “This law, which has replaced CrPC, claims to be justice, but in reality it has become a weapon to crush the opposition.” Citing Section 223 of BNSS, he said that it is mandatory to record the statements of the complainant and witnesses before the notice, but this did not happen in his case. Owaisi said angrily, “Allahabad High Court has given a clear verdict on this section that notice without statement is illegal. Then why this discrimination against me?”
‘Political vendetta notice against me’
He said, “I received the notice on October 8, when Section 163 was in force in Delhi. The city was turned into a fort in the name of protests, but why no notice to the Congress or other opposition parties? Is it because I am the most vocal on the government’s policies?” Owaisi asserted, “Forensic investigation in BNSS is mandatory for crimes punishable with punishment of more than seven years, but the procedure was not followed in my case. This notice is political vendetta.”

Referring to the 2023 session, Owaisi said, “The history of suspending 151 MPs in the Lok Sabha is being repeated. I chose politics to serve the country and not out of fear. If BNSS is a guarantee of justice then it should apply equally to everyone. Otherwise it is an attack on democracy.” The opposition applauded in the House, while the ruling party raised objections. The Home Minister replied that the notices were part of the legal process, but Owaisi termed it as blasphemous justice.
This incident is raising questions on the effectiveness of BNSS. Owaisi warned, “The provision to extend police custody by 15 days will make bail more difficult.” The opposition is now preparing to go to the Supreme Court. Owaisi finally said, “I am not afraid. This fight is for justice and democracy.”
