A few days before its release in theatres, Emraan Hashmi and Yami Gautam’s film ‘Haq’ is embroiled in legal controversies. In fact, the family of Shah Bano, on whom the film is based, has alleged that it violates their privacy and that the film makers did not take their consent before making the film. Shah Bano’s granddaughter has approached the court demanding a ban on the release of the film.

Shah Bano’s daughter Siddika Begum has filed a petition in the Indore bench of Madhya Pradesh High Court seeking a stay on Haq’s release. This film is going to be released in theaters on 7th November. Siddika’s lawyer Tausif Warsi said that the filmmakers had not taken the approval of Shah Bano’s family before using her name or life story.
Warsi told ANI, “The film is based on the landmark case of M.A. Khan vs Shah Bano Begum. For the first time in Indian history, a Muslim woman fought for maintenance and won the case… It is mandatory to take the consent of someone before using their personal life or name as it comes under the right to privacy.”

Shah Bano’s grandson Zubair Ahmed Khan has also expressed his views on the film being made without the consent of the family. He said, “When the teaser was released, we came to know that a film has been made on my grandmother. Many facts have been distorted in the teaser. This is our personal matter which has been given a commercial shape. They should have taken our permission. Common people will watch the film and think that it depicts true events.”
However, the filmmakers say that liberties have been taken to dramatize the events and it is a fictional one. Makers’ lawyer Ajay Bagadia said, “The film’s disclaimer clearly states that this film is inspired by two things: the 1985 Supreme Court decision in favor of Shah Bano and a book named ‘Bano, Bharat ki Beti’. This is a fiction and it is not necessary that everything be presented factually.”
Legal notice has been sent to the makers
Earlier, Shah Bano’s daughter Siddika Begum had also sent a legal notice to the producers demanding an immediate ban on the “publication, screening, promotion or release” of the film.

Directed by Suparn S Verma, Haq is based on the 1985 historical Shah Bano case, which dealt with women’s rights and maintenance laws in India. In 1978, Shah Bano, then 62, filed a petition in an Indore court seeking maintenance from her divorced husband, Mohammad Ahmed Khan, a wealthy and well-known lawyer. The couple were married in 1932 and had five children. In 1985, the Supreme Court ruled that Shah Bano was entitled to maintenance under Section 125 of the Code of Criminal Procedure. However, the next year, the Rajiv Gandhi government passed a law that effectively repealed the decision.
