What is the rule of compensation in international flights?

If an accident happens in an international flight. So compensation is done under the Montreal Convention 1999. India is part of this international treaty. Therefore, the same rules apply to international flights flying from here or coming here. Under this convention, a compensation of up to 128821 Special Drawing Rights i.e. SDR is fixed for each passenger.

In Indian currency this amount comes to around Rs 1.4 crore. However, the actual amount depends on the value of SDR and the currency rate at that time. But if it is proved that the accident happened due to the negligence of the airlines, then compensation can be given more than the prescribed limit.

What do the rules say for domestic flights?

The Montreal Convention does not directly apply to domestic flights. But in India, the safety of passengers has been decided under the guidelines of DGCA. Most Indian airlines provide accident cover to passengers even on domestic flights. The amount of compensation may vary depending on the airline and insurance policy, but generally it ranges from Rs 20 lakh to Rs 1 crore.

In many cases this responsibility is shared between the airline and its insurance company. If the passenger has taken separate travel insurance while booking the ticket.
