The Supreme Court on Monday (16 February) heard a case related to physical relations. The Supreme Court said, before marriage, a boy and a girl should be careful before having physical relations, because both are strangers to each other. The court made this comment while hearing the bail petition in a case related to allegations of rape and promise of marriage.
The young man had filed a bail petition in the Supreme Court, accused of having physical relations with a woman by promising to marry her and then marrying another woman, despite being married. A bench of Justice B.V. Nagarathna and Justice Ujjwal Bhuyan heard the case.
According to the report of Live Law, Justice Nagarathna said during the hearing of the case, caution should be taken before having physical relations before marriage. He said, “We may be old-fashioned, but before marriage a boy and a girl are strangers. Whatever may be the ups and downs in their relationship, we are unable to understand how they can have physical relations before marriage.”
According to the report, the complainant met the accused through a matrimonial website in the year 2022. It is alleged that the accused made a false promise of marriage to the woman and had physical relations several times on the pretext of luring her. According to the complainant, on the request of the accused, she also went to Dubai, where relations were established with him by showing him the dream of marriage and private videos were also made without permission and if she protested, she was threatened to make them viral.
According to the complainant, later she also came to know that the accused was already married. During the hearing on the case, the court also questioned the complainant about going to Dubai before marriage. On which it was said that both were planning marriage. On this, Justice Nagarathna said that if the woman was serious about marriage then she should not have gone with the accused before marriage.
Let us tell you that the District Court and Delhi High Court have rejected the bail petition of the accused. After this the accused has filed a Special Leave Petition (SLP) in the Supreme Court.
