The ongoing family dispute over businessman Sanjay Kapoor’s assets worth billions of rupees took a new turn in the Delhi High Court. Advocate Rajeev Nair, appearing on behalf of Priya Kapoor, argued in the court that the allegations made regarding the will are baseless and fabricated.
In the Delhi High Court, the lawyer of Sanjay Kapoor’s wife Priya Kapoor told the court that neither any challenge to the will nor any legal reason has been given in the petition of Karisma Kapoor’s children. The will was made public on July 30 and was read out to everyone. Yet there is no mention of it in the petition filed on September 9. The will was officially given on 15 September but he made no amendments to his claim.
It is wrong to call the will fake due to wrong spelling in the will – Lawyer
Priya Kapoor’s lawyer said in Delhi High Court that this is not a matter of will authentication process and no direct question has been raised on the validity of the will. Arguing in the court, he said that if someone’s name is written in wrong spelling or Testatrix is written instead of Testator, will that make the will invalid? Can a person’s last wish be negated on such minor mistakes?
No one rejected Sanjay Kapoor’s signature
While arguing in the Delhi High Court, Priya Kapoor’s lawyer said that no one has rejected Sanjay Kapoor’s signature on the will. Merely on the basis that the will came to light late, it cannot be called false. A will can remain in someone’s pocket or locker for years, this does not affect its authenticity.
Sanjay Kapoor’s children had expressed objection to the will.
Sanjay Kapoor’s children claimed in the Delhi High Court that their names have been wrongly written in the will and their addresses are also wrong at many places, which is completely contrary to their father’s wisdom and accuracy. He said that this will is fake and insulting. At present, Delhi High Court will hear this matter on Friday. In such a situation, it is very important to see who gets relief in this dispute of Sanjay Kapoor’s will.
