The Supreme Court did not listen to the demand for concession in the age limit in government jobs to Kashmiri Hindus who were displaced due to violence in 1990. The court said that this is a policy subject. He will not interfere in this. The petition of an organization named Panun Kashmir Trust said that such relief has been given to the victims of the 1984 anti -Sikh riots and the 2002 Gujarat riots, but Kashmiri Hindus have been denied it so far.
Panun Kashmir filed a PIL in the Supreme Court under Article 32 of the Constitution. A bench of Justice Vikram Nath and Justice Sandeep Mehta refused to listen to the case.
Referring to the exile and forced migration from the valley in January 1990, the petition said that the Kashmiri Hindu community has been deprived of its fundamental rights for the last three decades. His younger generation spent life in refugee camps and temporary settlements. Due to the harsh policy regarding the age limit, he is facing obstacles in getting employment.
It was argued in the petition that not giving age to Kashmiri Hindus shows ‘malicious discrimination’. In the Constitution, citizens have been given the right to equality, justice and dignity. Such discrimination violates these fundamental rights. Kashmiri Hindus should be identified and they should be given constitutional protection. Apart from the central government, Union Territory of Jammu and Kashmir was also made defendants in the petition.
