The Maharashtra government cabinet approved the amendment of the law to increase the daily working hour from nine to 10 hours in private institutions. Officials gave information about this on Wednesday (3 September). Currently, nine hours are scheduled for one day shift in the private sector in Maharashtra. An official order stated that the objective behind this decision is to attract investment, generate employment and protect the rights of workers. The cabinet meeting held on Wednesday was chaired by the state CM Devendra Fadnavis. These changes will apply to establishments with 20 or more workers.
Which states have a 10-hour shift applicable?
It has been implemented in Karnataka, Tamil Nadu, Telangana, Uttar Pradesh and Tripura before Maharashtra. Now amendment will be done at the Factory Act 1948 of Maharashtra and Maharashtra Shops and Establishment (Regulation of Employment and Condition of Service) Act 2017.
What will change in Maharashtra?
According to the news agency PTI, this amendment will allow to work without any hassle during peak demand or labor shortage. Also, it will also be ensured that workers get proper overtime. With this, the limit of Daily Working Hour will increase from nine hours to 12 hours. Rest break will be given after six hours instead of five hours.
Written consent of workers mandatory
With the compulsory written consent of the workers, the limit of overtime will increase from 115 hours to 144 hours. Weekly hours will also increase, which will increase from 10.5 hours to 12 hours.
Establishments providing employment to less than 20 workers will no longer need a registration certificate but they have to inform the authorities. According to the government, this decision is expected to promote Ease of Doing Business, new investment and generate employment. Along with this, double payment for overtime will also be ensured. The State Labor Department had put this proposal before the cabinet last week.
