‘Mamata Banerjee committed a crime, this raid has nothing to do with TMC’, ED argues in Kolkata HC in I-PAC case

Hearing has started in Kolkata High Court regarding ED raid in the office of I-PAC. The lawyer of the investigating agency Enforcement Directorate argued that this petition is pending in the Supreme Court on which the hearing can happen soon, hence the hearing of this case should be postponed today. The lawyer of West Bengal government opposed this demand of ED.

Trinamool Congress’s lawyer said, ‘We are not a party before the Supreme Court. Raids were conducted. Our confidentiality must be maintained. We live in a constitutional democracy. We want our political data to be secure. We have the right to privacy. Our only demand is that our political data should be kept safe, it should not be released in the media nor should it be used for political purposes.

Raid has nothing to do with TMC: ED

ED’s lawyer said, ‘No records were seized by the investigating agency. This petition has been filed by a stranger. Please see who the petitioner is. How was he affected because he was not present at the time of the raid. This investigation has nothing to do with Trinamool Congress and the person whose house and office were raided has not himself come to the court.

We have nothing, Mamata Banerjee took the files: ED

The lawyer of the investigating agency said, ‘No documents have been seized from our side, on the contrary, West Bengal Chief Minister Mamata Banerjee has taken the documents. They have taken possession of the records illegally and have committed a crime. Unless TMC makes him a party, the petition is not maintainable.

The lawyer of Trinamool Congress said that the lawyers of the Enforcement Directorate who are saying that they did not take the documents, the court should take this matter on its record. He said that this is directly related to the elections and our intention is that the elections should be conducted in a fair manner. ED’s lawyer reiterated that nothing has been seized from our side, on the contrary, Mamata Banerjee confiscated the documents and went away.

Court disposed of TMC’s petition

Accepting the demand of the lawyer of Trinamool Congress, the court has mentioned in its order that the investigating agency Enforcement Directorate has stated on the basis of its Panchnama that the ED has not seized any document during the raid. In such a situation, the petition filed by Trinamool Congress has no meaning because the apprehension was expressed by Trinamool Congress that the data collected by the Enforcement Directorate can be used politically. Therefore, the court disposed off the petition of Trinamool Congress.

The biggest news coming out from today’s hearing is that the investigating agency has clearly stated in the court that they have not seized any document of any kind during the raid. On the contrary, Mamata Banerjee had left from there with the documents.
