Delhi High Court has ended the suspension of former acting Vice Chancellor of Jamia Millia Islamia, Professor Iqbal Hussain. The court clearly said that prolonged departmental action against an employee is neither in the interest of the employee nor in the interest of the organization. The court believes that such a situation creates unnecessary trouble and the work is also affected. However, some other discussions are also taking place regarding the matter.
The case was heard by the division bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia. Pro. Iqbal Hussain had filed an appeal in the High Court challenging his suspension by Jamia Millia Islamia. During the hearing, the university told the court that the suspension order had already been withdrawn.
University withdrew suspension
During the court hearing, Jamia Millia Islamia administration was in disgrace. He informed the court that the suspension order issued on 6 September 2024 has been withdrawn and a new order in this regard has been issued on 20 January 2026. Taking this information on record, the High Court told Prof. Gave relief to Hussain. Also, they were allowed to start their academic and teaching work again.

However, the court also made it clear that till the completion of the departmental investigation, Prof. Iqbal Hussain will not handle the responsibility of estate officer. The court said that this arrangement should remain in place until the investigation is completed, so that there is no conflict of any kind.
Question on investigation pending for one and a half year?
The High Court also noted in this case that Prof. The ongoing departmental inquiry against Hussain has been pending for more than one and a half years. The court said that such a long investigation causes mental and professional harm to the employee. In view of this, the court directed the university to complete the investigation within six weeks.
The whole matter is related to land purchase
This entire controversy is related to a decision of the Executive Council of Jamia Millia Islamia. Pro. Iqbal Hussain, who has also been the former Dean of the Faculty of Law. Opinion was sought on behalf of the university in the matter of purchasing a land. This land was located near the university and it was being considered to buy it.
Pro. Hussain gave this advice
Pro. Hussain suggested against purchasing the land in his opinion. He said that the university should make proper use of the already existing land and spend the money on important works like medical college and other educational development. He believed that buying land unnecessarily would not be the right decision.
Council members supported
Pro. This opinion of Hussain was supported by most of the members of the Executive Council. After this the council decided that the university would not buy that land. On the instructions of the Council, Prof. Hussain informed this decision in writing to the land owner and said that no objection certificate will be issued in this case. Pro. Despite Hussain implementing the council’s decision, the university administration suspended him. He approached the Delhi High Court regarding this suspension.
According to reports, this action was taken against Prof. Iqbal Hussain by the then acting Vice Chancellor of the institute, Prof. Mohammad Shakeel on charges of misuse of position. After this, the next acting Vice Chancellor Prof. Mazhar Asif also did not pay much attention to this matter. Due to which Prof. Hussain’s investigation remained in limbo. Prof. Iqbal Hussain has also been the former acting Vice Chancellor of Jamia.
Lawyers made these allegations
Pro. Advocate Advait Ghosh and Advocate Ankur Chibber represented Hussain in the court. Lawyers said that Prof. Hussain had acted as per the decision of the Executive Council and there was no misconduct against him. Despite this he was suspended for malicious reasons.
