Delhi high court rahul gandhi citizenship: The central government on Wednesday informed the Delhi High Court that the issue of Indian citizenship of Congress leader Rahul Gandhi is under consideration before the Ministry of Home Affairs. Considering the arguments of the Center’s lawyer, a bench of Chief Justice DK Upadhyay and Justice Tushar Rao Gedela deferred the hearing of the case till 28 May. Bharatiya Janata Party (BJP) leader Subramanian Swamy has requested the High Court to direct the Ministry of Home Affairs to take a decision on Rahul’s citizenship. Additional Advocate General Chetan Sharma told the High Court, “The matter is under consideration.”

The bench was also told that the Allahabad High Court, which is hearing a similar petition, had recently given four weeks to the Ministry of Home Affairs to convey the results of the proceedings. When Swamy requested the court to direct Rahul to file a reply on the letter issued by the Ministry of Home Affairs, the bench said that it cannot interfere in the proceedings of the ministry.

Delhi High Court said- we cannot force

The bench of the Delhi High Court said, “We cannot force it. The proceedings are under consideration before the Ministry. It is the job of the ministry to take a decision. We cannot interfere in the proceedings of the ministry and cannot issue any instructions to anyone involved in the proceedings before the Ministry. “The Delhi High Court on February 19 asked the Central Government to inform him about the status of Swami’s representation given to the Ministry of Home Affairs to take a decision on Rahul’s Indian citizenship issue.

‘Rahul Gandhi violates the rules, canceled citizenship’

Swami’s petition filed through advocate Satya Sabharwal said that a letter was sent to the ministry on 6 August 2019, alleging that Rahul had voluntarily disclosed to the British government that he had Britain’s citizenship, which is equal to holding British passports. Swamy has said that despite being an Indian citizen, the Congress leader has violated the Article 9 of the Constitution and the Indian Citizenship Act and his Indian citizenship should be canceled.
