Supreme Court Angry on Ed Over Probe in Tasmac CJI Br Gavai Asks why Ed Interfering Id Interfering Into States Investigation Ann | ‘ED is breaking all limits …’, know

The Supreme Court has stayed the action of the Enforcement Directorate (ED) against the liquor retail government corporation TASMAC in Tamil Nadu. The bench headed by Chief Justice Bhushan Ramakrishna Gavai expressed strong displeasure over the attitude of the ED during the hearing. The bench said that the agency has crossed all limits.

The Tamil Nadu government said that it has filed 41 FIRs against Tamil Nadu State Marketing Corporation (TASMAC) officers and employees between 2014 and 2021. State agencies are investigating other allegations, including disturbances in giving liquor sales license. Meanwhile, the ED registered a case in the case. This case is directly against the corporation.

The Chief Justice expressed strict surprise on this. He said, ‘made the corporation an accused? ED is breaking all limits. Senior advocate Kapil Sibal, appearing for the Tamil Nadu government and senior advocate Mukul Rohatgi, presented for Tasmac, accused the employees of misbehaving during the raid in the corporation’s office. He said that everyone’s phone has been cloned. ED violated the right to privacy.

Sibal and Rohatgi also said that ED had no role in the case. On this, the Chief Justice once again said that the ED is breaking all the limits. The federal structure is not being consulted. When the state government is investigating, what was the need to interfere in this way?

Additional Solicitor General SV Raju, presented for ED, accused the case of financial disturbances of Rs 1000 crore in the case. He said that ED has sufficient basis of action. On this, the court asked him to file a reply in 2 weeks. The court made it clear that at present, the action of the ED in the case will be postponed.

Earlier on 23 April, the Madras High Court dismissed the Tamil Nadu government’s petition. The High Court upheld the ED investigation and raid against Tasmac. The high court had also rejected allegations of misconduct from employees. The High Court had said that the women employees were deliberately put forward so that there was obstacle in the ED raid.
