Supreme Court did not listen to the demand for investigation into Rahul Gandhi’s ‘vote theft’ allegations, a lawyer associated with Congress had filed a petition.


The Supreme Court has rejected the demand for investigation into the allegations of ‘vote theft’ being made by Rahul Gandhi. This petition was filed by Congress-affiliated lawyer Rohit Pandey. The petitioner had described Rahul’s allegations as very serious and had demanded the formation of an SIT under the chairmanship of a former Supreme Court judge for investigation.

The bench of Justice Surya Kant and Justice Joymalya Bagchi said that if the petitioner had any problem, he should have gone to the Election Commission. The Supreme Court will not hear this petition ‘allegedly filed in public interest’. The lawyer appearing for the petitioner said that he has given a memorandum to the Election Commission. On this the court said, ‘You should consider other legal options.’

In his petition, Rohit Pandey had based the allegations made by the leader of opposition in the Lok Sabha, Rahul Gandhi on August 7. It was said in the petition, ‘This is not a matter of any one election. The Constitution gives the right to vote to all adult citizens. This constitutional promise will be weakened by wrongly adding or removing names from the voter list.

The petitioner had said that he has filed this petition to maintain the credibility and transparency of the electoral process. The court should order an independent audit of the voter list. Also ask the Election Commission not to make any changes in the voter lists until this audit is completed. The court should also give necessary instructions for transparency in the preparation, maintenance and publication of voter list in future.

The petitioner had said that if large-scale tampering in the voter list is proved, it would be against the principle of ‘one person, one vote’ given in Articles 325 and 326 of the Constitution. Giving someone the right to more than one vote will also violate the fundamental right to equality.
