The Supreme Court on Wednesday (May 21, 2025) ordered the release of Associate Professor Ali Khan Mahmudabad of Ashoka University on interim bail, but has also reprimanded the professor. Justice Suryakant said that the things that the professor has written in the post on Operation Sindoor is called Dog Vistling. He has asked the professor what he needed for this chip publicity. The professor posted a social media on Operation Sindoor of the Indian Army, for which the Haryana State Women’s Commission lodged an FIR against them. The professor was arrested on Sunday and on Tuesday, the district court ruled to send Ali Khan to a judicial custody by 27.
Justice Suryakant and Justice N. Kotishwar Singh’s bench was hearing the petition of Professor Ali Khan. Justice Suryakant said that the terrorists come and attack our country and you need this chip populator. Senior Advocate Kapil Sibal was keeping side by Ali Khan.
Justice Suryakant said, ‘Everyone has the right to independent speech and freedom of expression …. But is it time to talk about them all? The country is already going through. Some terrorists came to our country and attacked people … We need to unite. At such a time, such a chip populator was required? ‘
Kapil Sibal said that there was no wrong intention behind the posting of Professor Ali Khan. On this argument, Justice Suryakant said, ‘You should know what is happening in the country. You are free to speak… But where is your duty? ‘ He said that the things that the professor has written in his post is called dog whisling.
Justice Suryakant expressed displeasure over the post, saying, “It is a matter of great misfortune for the freedom to speak, that words are deliberately selected to humiliate and hurt the other party.” Justice Suryakant said that the petitioner is a professor, he will not have a shortage of words. He could also choose such words, which could not hurt anyone’s feeling, he could use neutral language.
Professor Ali Khan filed a petition in the Supreme Court on May 19 against the arrest. On behalf of Associate Professor Mahmudabad, Senior Advocate Kapil Sibal had requested an immediate hearing on it, referring to the case before the bench led by Chief Justice Boy Ramakrishna Gavai.
Haryana Police arrested him on 18 May after two objections were registered against Mahmudabad. He is accused that his social media posts about Operation Sindoor threatened the sovereignty and integrity of the country. Mahmudabad was produced in a local court in Sonepat on 18 May and was sent to two days police custody in a case filed on a complaint by Haryana State Women’s Commission a day earlier. On Tuesday, the Sonepat court sent him to judicial custody till 27 May after the completion of the period of police custody.
