Delhi CM Rekha Gupta welcomed the Supreme Court’s decision to deny bail to activists Umar Khalid and Sharjeel Imam in the 2020 Delhi riots conspiracy case. He said that those who pushed the city into the fire of violence should get the harshest punishment. The Supreme Court on Monday (05 January) clearly refused to grant bail to Umar Khalid and Sharjeel Imam in the Delhi riots case. However, the court gave relief to five other accused in this case and granted bail.

CM Rekha Gupta said, “The bail of 2020 Delhi riots accused Umar Khalid and Sharjeel Imam was rejected by the Supreme Court.” We welcome the decision of the Honorable Court. Those people who pushed Delhi into riots should get the harshest punishment. A strong message should also be given to those political parties who supported such rioters, they too deserve punishment.

What did Delhi Minister Kapil Mishra say?

Delhi Law Minister Kapil Mishra also gave his reaction on this. He said, “The Supreme Court’s decision has confirmed that the riots were the result of a well-planned conspiracy. Today’s decision once again proves that a deliberate conspiracy was hatched against the people of Delhi. This decision gives a clear message that such conspiracies will not be tolerated.

Court’s order will become an example- Ashish Sood

Meanwhile, Delhi Government Home Minister Ashish Sood said, “The court’s order will set an example for those working against the country.” There is nothing wrong in opposing the government, but opposing the country is a different thing. It is unfortunate that some people show sympathy towards those accused of working against the country.

Rioters should be given strict punishment – Manjinder Singh Sirsa

Along with this, Environment Minister Manjinder Singh Sirsa in Rekha Gupta’s government said that the rioters should be given strict punishment. He thanked the Supreme Court for giving a strong message. The minister said, “Nobody has the right to create unrest or take lives of innocent people. Such decisions can help prevent violence in the future. In February 2020, 53 people were killed and more than 700 were injured in the riots in North-East Delhi.

Khalid’s father Syed Qasim Rasool Ilyas spoke to abp news about New York Mayor Zohran Mamdani’s letter in support of Umar Khalid and BJP’s reaction to it. He said that the former PM of Bangladesh is in our country. Our country commented on them and also commented on the trial. Is this not interference in the affairs of another country?

Umar Khalid’s father Syed Qasim Rasool Ilyas further said, “No one has commented on the judiciary. When the people of BJP themselves raise their voice in the affairs of other countries, then in which box will they put it? Is there no interference? BJP should see that what is happening in our country that people are not getting bail without trial for last 5 years, then it should express concern on this.

Mamdani wrote a letter in support of Omar Khalid

New York City Mayor Zohran Mamdani has written a letter in support of JNU alumnus Umar Khalid. In this he has mentioned the thoughts of Omar Khalid. This letter of Mamdani was shared by Khalid’s associate Banojyotsna Lahiri on the social media platform ‘X’. The caption accompanying the photo of Mamdani’s letter to Khalid read, “When prisons try to isolate people, your words become power and spread.”

We are all thinking about you – Mamdani

This letter is hand written and it also has the signature of New York Mayor Mamdani. In this letter he wrote, “Dear Omar, I often remember your words about not letting bitterness dominate you. Nice to meet your parents. We are all thinking about you only.

Meanwhile, a group of American lawmakers has written a letter to Indian Ambassador to the US Vinay Kwatra demanding bail for Omar Khalid and ensuring a fair and timely trial as per international law.

In which case is Umar Khalid an accused?

A case was registered against Umar Khalid and some others under provisions of the stringent anti-terrorism law, Unlawful Activities (Prevention) Act, 1967 (UAPA) and IPC for being the key conspirators in the Delhi riots 2020 case. 53 people were killed and more than 700 people were injured in this riot.

Former Chief Minister of Jammu and Kashmir and PDP chief Mehbooba Mufti once again raised the issue of not getting bail to Umar Khalid. He said that Umar Khalid had not said anything wrong, he had not broken any bounds of decorum, but today he is not getting bail for five years. With great difficulty he was allowed to attend his sister’s wedding.

Mehbooba Mufti said, “We do not even talk to the youth about what they think, what they do. What problems are there in his mind? Who should he talk to? I don’t know how much you can speak in Jammu but you cannot talk in Kashmir.

‘Umar Khalid did not break any bounds of etiquette’

Referring to former JNU student Umar Khalid, the PDP chief said, “Umar Khalid had not said anything wrong, he had not broken any bounds of decorum, but today he is not getting bail for the last five years.” With great difficulty he was allowed to attend his sister’s wedding. So somewhere within our country this system has been formed.

Challenges and opportunities are not different – Mehbooba Mufti

He further said, “This is not just intolerance against Muslims but general intolerance. Today there are challenges here, so I say there is opportunity with them. Challenges and opportunities are not different. There is a question and an answer, so where there is a question there will be an answer also.

Khalid got interim bail for his sister’s marriage.

It is noteworthy that on December 11, Delhi Court had granted interim bail to former JNU student Umar Khalid to attend his sister’s wedding. During this time also the PDP chief had given his reaction. He had alleged that it was surprising that Umar Khalid had to wait 5 years for 13 days parole to attend his sister’s wedding. Umar Khalid is an accused in the case related to the conspiracy of 2020 Delhi riots.

Activist Umar Khalid, seeking bail in the UAPA case related to the February 2020 riots in Delhi, told the Supreme Court on Friday (October 31, 2025) that there is no evidence linking him to the violence and the allegations of conspiracy leveled against him are false.

Senior advocate Kapil Sibal, appearing for Umar Khalid, told the bench of Justice Arvind Kumar and Justice NV Anjaria that there has been no recovery of money, weapons or any physical evidence linking him to the 2020 Delhi riots.

He said, ‘There are 751 FIRs, I have been accused in one, and if it is a conspiracy, then it is a bit surprising!’ Kapil Sibal said, ‘If I (Umar Khalid) had planned the riots, then I was not in Delhi on the dates when the riots took place. I have not yet found any money, weapons or physical evidence linking me to violence.

He said that the statement of any witness does not actually link the petitioner to any act of violence. Kapil Sibal argued that Khalid is entitled to bail on the basis of equality. He said that his fellow activists Natasha Narwal, Devangana Kalita and Asif Iqbal Tanha had got bail in June 2021.

He said that while refusing to grant bail, the Delhi High Court had termed Umar Khalid’s speech in Amravati on February 17, 2020 as inflammatory. Kapil Sibal said, ‘It is available on YouTube. It was a public speech, in which I (Khalid) talked about Gandhian principles. Meanwhile, senior advocate Abhishek Singhvi, on behalf of Gulfisha Fatima, argued that she has been in jail for five years and five months since April 2020.

Abhishek Manu Singhvi said that the main chargesheet was filed on September 16, 2020, but the prosecution has made it an annual trend to file supplementary chargesheet every year. He said there has been inordinate delay in considering Fatima’s bail plea, which has been listed more than 90 times since 2020.

Senior advocate Siddharth Dave, on behalf of Sharjeel Imam, said that it took three years for the police to complete their investigation. He said, ‘I (Sharjeel) had given these speeches about two months before the riots.’ Dave said that there is no direct or close connection to show that Sharjeel instigated the violence.

The hearing remained inconclusive and will continue on November 3. Delhi Police on Thursday opposed the bail pleas of the accused, saying that they conspired to attack the sovereignty and integrity of the country by carrying out a regime change campaign under the guise of peaceful protest.

Khalid, Sharjeel, Gulfisha Fatima and Meeran Haider were booked under provisions of the Unlawful Activities (Prevention) Act (UAPA) and the then Indian Penal Code for allegedly being key conspirators in the February 2020 riots. 53 people were killed and more than 700 were injured in these riots. This violence took place during protests against the Citizenship (Amendment) Act (CAA) and the National Register of Citizens (NRC).

Delhi news: The objection of the Delhi Police on the bail of former Congress councilor Ishrat Jahan has once again intensified the political and legal movement in the entire case. The Delhi High Court on Friday, taking major action in this case, has summoned the entire record in the digital format from the subordinate court.

The bench of Justice Naveen Chawla and Justice Shalinder Kaur made it clear that now the matter has become a legal investigation of not just a bail, but the taunts of the riots and the fabric of the conspiracy. The next hearing of the case has been decided on 18 July.

What was the matter?

Violence erupted in North-East Delhi during protests against CAA and NRC in February 2020. 53 people were killed and hundreds were injured in these riots. Delhi Police claims that this was not a sudden incident, but a pre -planned conspiracy, which included many faces including Ishrat Jahan.

Bail became the center of dispute

Ishrat Jahan was granted bail by the trial court on March 14, 2022. The court had found that she was neither the mastermind of any conspiracy, nor was she a member of a violent WhatsApp group nor was it present on the spot during the riots. The court also admitted that Khoreji, the protest site, where she was active, was away from the center of riots. But Delhi Police says that the lower court ignored the seriousness and impact of the crime. He claims that the flywheel-jam and the alleged conspiracy were a kind of terrorist act, which not only destroyed life, but also challenged national security.

Big conspiracy or law protecting?

Ishrat Jahan is not alone in this case. Names like Omar Khalid, Natasha Narwal, Dewangana Kalita, Safura Jargar, former AAP councilors Tahir Hussain and Khalid Saifi are also included in the accused list. Action is being taken under strict laws like illegal activity (prevention) Act i.e. UAPA.

Will the bail game change?

Now the question is whether the appeal of Delhi Police in the High Court will turn Ishrat Jahan’s bail? Or will the decision of the lower court remain intact? This will be clear only on July 18, but one thing is certain that the legal saga of Delhi riots is not over yet.
