Allahabad High Court gave an important decision on Monday (2 February). The court has clarified that no person or community is required to take prior permission from the state government or administration to organize a religious prayer meeting in its private premises. The court said that this right is a part of the fundamental rights granted under Article 25 of the Constitution of India, which cannot be limited under normal circumstances.

High Court cited Article 25

Referring to Article 25 in its decision, the High Court said that every citizen has the freedom to believe, practice and propagate his religion. When a religious activity is being carried out entirely within private property and in a peaceful manner, it is not appropriate to force it to be permitted within the limits of the law. Administrative interference in such cases would be contrary to the basic spirit of the Constitution.

This right will be limited to private property

However, the court also made it clear that this freedom will be valid only if the religious prayer meeting is organized entirely within private premises. If the nature of the meeting is such that its influence reaches the public area, or it affects public order, peace or traffic, then the administration can take necessary steps.

Different rules for public places

The court also made it clear that before holding any kind of religious gathering, event or procession in public places, it will be mandatory to inform the concerned police or administration. It is the responsibility of the administration to maintain law and order during events at public places, hence it is important to follow the rules in such cases.

what was the background of the case

This decision came during the hearing of a petition, in which the administrative objection to holding a prayer meeting in a private premises was challenged. The petitioner argued that banning peaceful religious activity in private property is a violation of fundamental rights. The court agreed with this argument and declared the administrative action unfair.

Importance of decision for future

This decision is being considered an important precedent for matters related to religious freedom in the future. This sends a clear message that the rights granted by the Constitution to private life and private property should be respected, provided they do not affect public peace and order.
