In the hearing of this case, well-known lawyer of Indian origin Neal Katyal will argue as the lead lawyer. Trump himself had said that he wanted to attend this hearing, but later he said that he did not want to divert attention from the seriousness of the court&#8217;s decision.</p>
<p style="text-align: justify;"><strong>What is the matter?</strong></p>
<p style="text-align: justify;">This case focuses on whether the US President has the authority to impose large-scale tariffs (import taxes) under the International Emergency Economic Powers Act (IEEPA) of 1977 or only the US Parliament (Congress) has this authority. Neel Katyal argues that the right to impose taxes and tariffs should not rest with the President but with Congress. Trump had said that this decision is so important that if he wins, America will become the richest and safest country in the world. But if we lose, the country may end up in a situation like third world countries.</p>
<p style="text-align: justify;"><strong>Who is Neel Katyal?</strong></p>
<p style="text-align: justify;">54 year old Neel Katyal is a lawyer of Indian origin who has argued more than 50 cases in the US Supreme Court so far. He also took part in the historic case like Al Gore vs Bush in the year 2000. He has also appeared in court against many decisions of President Trump. Like against the travel ban imposed on Muslim countries and efforts for rapid deportation. For this reason, he is also called Trump&#8217;s legal opponent (Trump tormentor) in the American media.</p>
<p style="text-align: justify;">Neil was born in Chicago. His mother was a doctor and father an engineer, who had gone to America from India. He studied law at Yale Law School, where he was mentored by renowned Indian-American legal expert Akhil Amar. His sister Sonia Katyal is a law professor at the University of California, Berkeley, while Akhil Amar&#8217;s brother Vikram Amar is the former dean of the University of Illinois Law College.</p>
<p style="text-align: justify;"><strong>Another Indian lawyer also in this case</strong></p>
<p style="text-align: justify;">Another Indian-American lawyer Prateek Shah is also involved in this case. He is the head of Supreme Court and Appellate matters in the law firm named Akin Gump. Prateek Shah is challenging the powers of the President on behalf of American companies like Learning Resources and hand2mind. The Supreme Court has decided to hear all these cases together. Interestingly, Katyal got the right to present this case by tossing a coin.</p>

<p style="text-align: justify;">The hearing of this case in the US Supreme Court will last for 80 minutes, whereas in normal cases only 60 minutes are available. The court is expected to be packed. The eyes of the whole world are fixed on whether the economic powers of the President will be limited or whether he will get more powers.</p>

<p style="text-align: justify;">A surprising incident has come to light in America. Here an Indian citizen has been accused of violence during an international flight. According to US officials, this man named 28-year-old Praneet Kumar Usiripalli attacked two passengers with a metal fork on Lufthansa Airlines flight LH-431 going from Chicago to Germany. Apart from this, he also slapped a female passenger. This incident occurred on October 25, after which the flight made an emergency landing at Boston Logan International Airport.</p>
<p style="text-align: justify;">According to the US Attorney&#8217;s Office, Praneet Kumar, who was on board the flight, suddenly became aggressive. He hit a 17-year-old teenager on the shoulder and another teenager on the back of the head with a metal fork, injuring both. When the flight crew tried to stop him, Praneet made a gun gesture with his hand and placed it in his mouth and pretended to fire. This action spread panic among the passengers and the situation started worsening.</p>

<p style="text-align: justify;">After the attack, Praneeth turned towards a female passenger sitting nearby and slapped her. The flight attendants immediately controlled him and tied him to his seat for safety reasons. After this the pilot diverted the plane towards Boston Airport, where the police arrested him.</p>
<p style="text-align: justify;"><strong>How much can be the punishment?</strong></p>
<p style="text-align: justify;">The US Federal Prosecution Office (US Attorney&#8217;s Office Massachusetts) said that Praneeth has been accused of assault with a dangerous weapon. This is a serious crime and if found guilty under it, he can face up to 10 years in jail, up to 3 years of supervised release and a fine of up to $250,000 (about ₹ 2 crore). </p>
<p style="text-align: justify;">According to officials, it is not clear whether there was any mental or personal reason behind the attack. The accused was arrested on October 25 and will soon be produced in the federal court in Boston.</p>

<p style="text-align: justify;">A federal appeal court in the US, giving possible relief for India, has declared the tariff imposed on India by President Donald Trump as illegal. The court said in its judgment that Trump did not have such widespread rights that he could impose such fees. However, the court has allowed Tariff to continue till October 14, so that the Trump administration can get a chance to appeal to the Supreme Court.</p>
<p style="text-align: justify;"><strong>Trump will challenge the court&#8217;s decision</strong></p>
<p style="text-align: justify;">Trump criticized the court&#8217;s decision, calling it biased. He said that he would challenge this decision in the Supreme Court, where he is expected to get help. Trump wrote on Truth Social, &#8220;If it is allowed to remain like this, this decision will truly destroy the United States.&#8221;</p>
<p style="text-align: justify;">Referring to the temporary ban, the Deputy Press Secretary of the White House, Kush Desai said that the tariffs imposed by the President will still be applicable and they hope that the government will win the matter in the end. This decision applies to taxes which were imposed under the law of international economic emergency and not the taxes related to security.</p>
<p style="text-align: justify;"><strong>Will India get relief?</strong></p>
<p style="text-align: justify;">If India survives the legal challenge in the US Supreme Court, then 25 percent tariffs imposed on it will definitely be removed. However, it is not clear whether the 25 percent of the punitive fee levied on purchasing oil from Russia is also involved in the decision, as Homeland Security Secretary Christie Nom says that the fee was levied to deal with the threat to the US from Russia.</p>
<p style="text-align: justify;">The court&#8217;s decision does not include the fees that have been imposed on steel, aluminum and copper due to national security, so it seems that the oil tariff on oil can still continue.</p>
<p style="text-align: justify;"><strong>Right to impose tariffs with US Parliament- Court</strong></p>
<p style="text-align: justify;">The US Court of Appeals have ruled by a 7-4 majority that the right to impose tariffs is mainly with the Congress (US Parliament), not to the President. This decision is against Trump&#8217;s tariff decision. The court said that the power to impose tariffs in the constitution has been given especially to the Congress.</p>
<p style="text-align: justify;">When the Trump government started a trade war, he used the IEEPA law and said that due to the trade deficit, there has been an economic emergency situation in the country. On the basis of this, he imposed tariff on goods. The court said that the law has not been given the right to impose tariffs or tax clearly.</p>
<p style="text-align: justify;">Former acting Solicitor General Neel Katiyal was among the major lawyers of the Democratic states and group of small businesses, who challenged Trump&#8217;s right to put tariffs in court.</p>

<p style="text-align: justify;"><strong>Tahawwur rana extradition:</strong> The US Supreme Court has dismissed his plea demanding a ban on sending Tawwur Rana to India under extradition to the Mumbai terror attack, which has removed another obstacle over handing over to Indian officials for justice.</p>
<p style="text-align: justify;">Rana, a 64 -year -old Canadian citizen of Pakistani origin, is currently closed at Los Angeles&#8217;s &#8216;Metropolitan Detention Center&#8217;. He is associated with Pakistani-American terrorist David Coleman Headley, one of the main conspirators of the attacks on 26 November 2008 (26/11). Prior to the attacks, Headley had done Reiki in Mumbai as an employee of Rana&#8217;s &#8216;Immigration Consultancy&#8217;.</p>
<p style="text-align: justify;"><strong>What was Rana&#8217;s application submitted on 27 February?</strong></p>
<p style="text-align: justify;">On 27 February, Rana submitted before the US Supreme Court Associate Judge and &#8216;Ninth Circuit&#8217; Circuit Judge Elena Kagan &#8216;Emergency application to stop the pending trial of the habeas corpus petition&#8217;. At the beginning of last month, Kagan rejected the application.</p>
<p style="text-align: justify;"><strong>What did the court say on the application of Tehwwur Rana?</strong></p>
<p style="text-align: justify;">After this, Rana renewed his application and requested that renewed application be sent to Chief Justice Roberts. An order post on the Supreme Court website states that Rana&#8217;s renewed application was listed for the &#8216;Conference&#8217; of 4 April 2025 and &#8220;application&#8221; has been sent to the court. &#8220;On Monday, a notice said in a notice on the Supreme Court website,&#8221; The court has rejected the application. &#8220;</p>
<p style="text-align: justify;"><strong>In which case Rana was convicted?</strong></p>
<p style="text-align: justify;">Rana was convicted in the US in a case of assisting Pakistan-based terrorist organization Lashkar-e-Taiba in a case related to providing assistance in terrorist conspiracy in Denmark. Lashkar is responsible for the Mumbai attack. Eminent Indian-American lawyer Ravi Batra of New York told &#8216;PTI-Bhasha&#8217; that Rana had applied to the Supreme Court to stop extradition. This application was rejected by Justice Kagan on 6 March. The application was presented to Roberts, &#8220;who shared it with the court to use the entire court&#8217;s approach.&#8221;</p>
<p style="text-align: justify;"><strong>Rana had said the danger of torturing him</strong></p>
<p style="text-align: justify;">In the emergency petition, Rana requested that as long as the ongoing case is pending in the US, his extradition process should be banned in India. He had demanded the postponement of the petition filed on 13 February on the basis of its merits. In that petition, Rana argued that his extradited India is a violation of the &#8216;United Nations Convention&#8217; against the US law and torture, &#8220;Because it is a sufficient basis to believe that the petitioner would be in danger of torture if he was extradited to India.&#8221;</p>
<p style="text-align: justify;"><strong>If sent to India, it is really &#8216;death sentence</strong></p>
<p style="text-align: justify;">The petition said, &#8220;The possibility of harassment in this case is even more as the petitioner is a Muslim of Pakistani origin in the Mumbai attacks.&#8221; The petition also states that extraditing him in Indian custody centers due to his &#8216;serious medical status&#8217; is also &#8216;really&#8217; death sentence. On January 21, the US Supreme Court rejected the application related to Rana&#8217;s original habeas corpus petition seeking a review of the lower court&#8217;s decision.</p>
<p style="text-align: justify;"><strong>Why PM Modi&#8217;s name in Rana&#8217;s application?</strong></p>
<p style="text-align: justify;">The application said that on the same day, the newly appointed Foreign Minister Marco Rubio met Foreign Minister S Jaishankar. When Prime Minister Narendra Modi arrived in Washington to meet Trump on 12 February, Rana&#8217;s lawyer received a letter from the State Department, stating that &#8216;the Foreign Minister has decided to&#8217; hand over &#8216;to India&#8217; to India &#8216;according to&#8217; the extradition treaty between the US and India &#8216;on 11 February 2025.</p>
<p style="text-align: justify;"><strong>Trump announced Rana&#8217;s extradition</strong></p>
<p style="text-align: justify;">During a joint press conference with Prime Minister Modi at the White House in February, President Donald Trump said that his administration has approved the extradition of &#8216;very wicked&#8217; Rana, which is looking for Indian law enforcement agencies for his role in the 26/11 Mumbai terror attack. A total of 166 people including six Americans were killed in the 2008 Mumbai terror attacks. These attacks were carried out by 10 Pakistani terrorists.</p>
