GRAP-4 Rules: Air pollution in Delhi NCR has once again reached dangerous levels. Because of this, the authorities have had to implement Graded Response Action Plan Grap-4. What is Grape-4?

This plan is implemented only when air pollution reaches dangerous levels and becomes a direct threat to public health. At this stage, normal regulatory measures are not considered sufficient and emergency restrictions are imposed to immediately reduce sources of pollution such as vehicles, construction dust and industrial emissions.

Penalty for violation of rules

Under the current enforcement framework, violation of Grape-4 restrictions can attract heavy financial penalties. Vehicles that fall in the restricted category, such as BS-III petrol and BS-IV diesel vehicles, can be fined up to ₹ 20,000 if found plying on the roads. Officials are also strictly checking the Pollution Under Control Certificate. Driving without a Pollution Under Control Certificate can result in a fine of up to ₹ 10,000.

What could be jail?

Violation of Grape-4 is not limited to era alone. The instructions issued under this rule are legally implemented under the Environment Act 1986. Disobeying pollution control orders is a criminal offense under Section 15 of this Act. This means that the violator can be punished with imprisonment of up to 5 years or a fine of up to ₹ 100,000 or both, depending on the seriousness and repetition of the offence.

Seizing the vehicle and taking action on the spot

Enforcement agencies have been given the authority to take immediate action on the spot. Vehicles violating Group 4 norms, especially trucks carrying construction material or those entering Delhi illegally, can be seized on the spot.
