<p style="text-align: justify;">Under the India-Bangladesh extradition treaty, India can also refuse to hand over Sheikh Hasina under Article 7 of the treaty. But there is a condition for this. In fact, both countries can refuse to each other against extraditing a person against whom a case is already pending in some other case in the country in which he has taken refuge. For example, if any criminal case was going on against Sheikh Hasina in India, India could have refused to extradite Sheikh Hasina, but this is not the case in her case.</p>
<h3 style="text-align: justify;"><strong>India can refuse extradition but&#8230;</strong></h3>
<p style="text-align: justify;">India may refuse to hand over Sheikh Hasina under Article 8 of the Bangladesh extradition treaty. A section of the treaty (Article 8) says that India can refuse extradition if the case is not made in “good faith in the interest of justice”. Meaning, if India believes that Bangladesh&#8217;s allegation is &#8220;political in nature&#8221;, then the government can refuse extradition. However, some crimes (such as murder, disappearance) do not fall within the definition of “political crimes” in the treaty, so this argument cannot fully apply to all the cases against Sheikh Hasina.</p>

<p style="text-align: justify;">The Bangladesh Hindu Buddhist Christian Unity Council (BHBCUC) on Thursday (August 28, 2025) expressed disappointment over the non -representation of minority communities among the newly appointed judges in the country. It said that 25 judges have been appointed as Additional Judges in the High Court Division of the Supreme Court in Bangladesh. These include 9 judicial officers, 9 lawyers and seven law officers.</p>
<p style="text-align: justify;">A statement issued by BHBCUC said, &#8220;The complete absence of individuals of religious and ethnic minority communities is extremely regrettable in these appointments. This is particularly worrying, because if the minority is about 10 percent of the population of the country, not a single person from these communities is included in these 25 newly appointed judges.</p>
<p style="text-align: justify;"><strong>New appointments of President of Bangladesh </strong></p>
<p style="text-align: justify;">On behalf of the council, Chairman Nim Chandra Bhowmik, Executive Chairman Ushatan Talukdar, Senior Vice President Nirmal Rojario and Acting General Secretary Monindra Kumar Nath expressed serious concern and resentment on the matter. Local media said that Bangladesh President Mohammad Shahabuddin made new appointments late on Monday night in consultation with Chief Justice Syed Refat Ahmed, which increased the number of High Court judges to 113.</p>
<p style="text-align: justify;">On Tuesday, the Chief Justice administered the oath to 25 newly appointed judges. Among the appointed judges, the father -in -law of the National Citizen Party (North) Sarjis Alam, Deputy Attorney General Lutfur Rahman has been appointed as Additional Judge of the High Court.</p>
<p style="text-align: justify;"><strong>Victims arbitrarily detained</strong></p>
<p style="text-align: justify;">According to the report of Bangladesh chief Bengali daily Prothom Aloe, Supreme Court lawyer Rahman was promoted to the post of Deputy Attorney General after demonstrations in July last year. Last month, the Awami League party of Bangladesh strongly condemned the &#8216;handicap and&#8217; state sponsored harassment &#8216;by the court under the interim government led by Mohammad Yunus in the country.</p>
<p style="text-align: justify;">The party said, &#8216;The judges are now directed by the Yunus -backed mob inside the court. The government sponsored attacks on lawyers wishing to provide legal services to deny the legal rights of the victims arbitrarily, which is ending the fairness and transparency of the judiciary.</p>
<p style="text-align: justify;"><strong>Judiciary is now under mobocracy</strong></p>
<p style="text-align: justify;">He said, &#8216;The state-propelled repression for the attackers and freedom from punishment. This clearly shows that the judiciary has become under the mobilization. Since the democratically elected government -elected government led by Sheikh Hasina, many judges and lawyers serving during their tenure have been arrested on concocted grounds. Experts believe that these latest appointments are a political move to carry forward the agenda of the interim government led by Mohammad Yunus.</p>

<p style="text-align: justify;">In Bangladesh&#8217;s International Crime Tribunal, a crime against humanity in a case of crime against humanity was formally framed on Thursday (July 10, 2025) in his absence. The special tribunal has set the date of the onset of the trial on August 3.</p>

<p style="text-align: justify;">The prosecution counsel told reporters, &#8220;Bangladesh International Crime Tribunal (ICT-BD) has also framed charges against Sheikh Hasina as well as home minister during his rule, Asdujman Khan Kamal and (erstwhile) Inspector General of Police (IGP) Chaudhary Abdullah al Mamoon.&#8221;</p>
<p style="text-align: justify;"><strong>Allegations of massacre, murder and torture also</strong></p>
<p style="text-align: justify;">The three have ordered a crime against humanity for their efforts to suppress the protests led by students in July-August last year. The prosecutors said that Hasina has also been accused of massacres, murder and torture to suppress the rebellion against Hasina.</p>
<p style="text-align: justify;">He said that the only present accused Mamoon was produced before the court, where he has accepted his crime. The remaining two accused, Sheikh Hasina and Asdujman Khan, will be prosecuted. <p style="text-align: justify;"><strong>The Yunus government has demanded the extradition of Sheikh Hasina from India</strong></p>
<p style="text-align: justify;">Let me tell you that earlier Bangladesh acting Mohammad Yunus government on Wednesday urged India to take care of &#8220;Vivek and Ethics&#8221; in dealing with Sheikh Hasina&#8217;s extradition request.
