Trinamool Congress (TMC) MP Abhishek Banerjee has got a big relief regarding the FIR registered against Union Home Minister Amit Shah for making statements. On Thursday (May 21, 2026), the Calcutta High Court, while giving protection to Abhishek Banerjee, stopped the West Bengal Police from taking any punitive action against him. However, the High Court has strongly reprimanded him for his comments and asked how being an MP, how can he make such irresponsible statements.

The Calcutta High Court on Thursday directed the West Bengal Police not to take any punitive action against Abhishek Banerjee till July 31. During the hearing, Justice Saugata Bhattacharya further said that this interim protection is being given on the condition that Abhishek Banerjee will cooperate in the police investigation.

The court also directed that the petitioner (Abhishek Banerjee) cannot travel abroad without prior permission and it is mandatory to give 48 hours notice to the investigating officer before any movement. The High Court gave this interim order on the petition of Abhishek Banerjee, in which he had sought quashing of a criminal case registered against him for his comments made in election rallies before the recently concluded West Bengal Assembly elections. He had said in the rally, ‘I will see who will come to save them on May 4. I will see which godfather will come from Delhi and save them? It is alleged that while addressing Amit Shah he had called him Godfather.

The complainant had accused the TMC MP of giving inflammatory speeches targeting opposition party workers and threatening Union Home Minister Amit Shah. Senior advocate Kalyan Bandyopadhyay appeared in the High Court on behalf of Abhishek Banerjee and alleged that the case against his client was malicious. He said, ‘It is against malicious prosecution immediately after the change of power.’

During the hearing, the court strongly criticized Abhishek Banerjee’s comments. The court emphasized that Abhishek Banerjee should not have made controversial comments at all. Calcutta High Court said on Abhishek Banerjee’s statement, ‘Why did you give such statements? Why made such irresponsible statements just before the elections? The history of this state has been such that there is violence after elections… this was shown everywhere in the media too. Does this statement match with the position of the petitioner (Abhishek Banerjee), who is the general secretary of a political party?

Advocate Bandyopadhyay said that when there has been no violence after this statement then why is this matter being raised. He said that the complainant feared that such a statement might incite violence, but it did not happen and the complainant has also not mentioned any such incident, so cognizance cannot be taken of this matter.

The court told Kalyan Bandyopadhyay, ‘How can such a statement be given while being an MP? This thing shakes the conscience of the court. I am saying it again, there was no need for such a statement. The court told him that although there was no violence after Abhishek Banerjee’s statement, what would have happened if the results had been different.
