<p style="text-align: justify;">Calcutta High Court has sent a notice to former West Bengal Chief Minister and TMC chief Mamata Banerjee and her nephew Abhishek Banerjee in the case of contempt of court. This notice is in relation to the annual Martyrs&#8217; Day rally of Trinamool Congress (TMC), which was called on 21 July 2025. This rally had violated the 2018 decision of the Calcutta High Court, which had given clear instructions to all political parties not to block any road in the city.</p>
<p style="text-align: justify;">Recently, a contempt petition was filed in the Calcutta High Court regarding the annual Martyrs&#8217; Day. This petition has been filed before the division bench headed by Justice Arijit Banerjee. A preliminary hearing in this regard was held on Friday (June 19, 2026). After this, the division bench ordered that contempt notices would be issued to Mamata Banerjee and Abhishek Banerjee. The next hearing of the case will be on July 3.</p>
<p style="text-align: justify;">Let us tell you that in 2018, the division bench of Calcutta High Court had ruled that no political party will block the main parts of the city. This decision was given by Justice Jyotirmoy Bhattacharya and Justice Arijit Banerjee.</p>
<p style="text-align: justify;">The then division bench had said in its decision that a part of the road should always remain open for pedestrians and drivers. A part of the road should always be open in case of emergency including ambulance. Apart from this, if necessary, another road should be arranged for easy movement of vehicles.</p>

<p style="text-align: justify;">In 2018, the High Court had ordered the police to inform people about traffic diversion through the media. Apart from this, the court had also said that if any situation of vandalism or violence arises during a political meeting or rally, then strict legal action will be taken against the accused.</p>
<p style="text-align: justify;">Recently, a second petition has been filed in the Calcutta High Court, in which it has been claimed that the decision of 2018 has been violated during the Martyr&#8217;s Day rally of Trinamool Congress on July 21 last year. The petition also claimed that TMC&#8217;s &#8216;Martyrs&#8217; Day&#8217; rally was held at Esplanade in Central Kolkata by completely blocking an important junction, causing immense inconvenience to the general public.</p>

Regarding this, Mamata Banerjee held a meeting with party MPs and MLAs at her residence in Kalighat. After the meeting, party MP Kalyan Banerjee said that Leader of Opposition (LoP) Ritabrata Banerjee appointed by the Speaker is illegal and the party will approach the High Court against it.</p>
<p style="text-align: justify;"><strong>TMC will approach High Court against LoP</strong></p>
<p style="text-align: justify;">TMC MP Kalyan Banerjee said, &#8216;We have decided that the Leader of the Opposition (LOP) appointed by the Speaker is illegal. We will go to the High Court against this on Monday (8 June 2026). We will file a petition in the High Court. We will fight against the way BJP is killing TMC workers and filing false cases against them. We will fight on the streets, we will fight in the court.</p>
<p style="text-align: justify;"><strong>Differences deepen over TMC&#8217;s successor</strong></p>
<p style="text-align: justify;">For almost 28 years, the internal system of Trinamool has been based on the same principle &#8211; the party and leader Mamata Banerjee are synonymous with each other. But now for the first time this equation is under serious challenge. The dissatisfaction that started within the party is now creating fear of spreading beyond the Assembly and reaching the MPs. Besides, deep differences are also emerging regarding leadership, succession and organizational control. The situation has reached such a stage that there is a possibility of future dispute over the control over the party&#8217;s symbol &#8216;Jora Ghas Phool&#8217; (flowers and grass).</p>

<p style="text-align: justify;"><strong>Ritabrata Banerjee claimed support of 60 MLAs</strong></p>
<p style="text-align: justify;">The proposal to nominate Ritabrata as the Leader of Opposition was supported by 58 Trinamool Congress MLAs, who signed the proposal and which was accepted by Speaker Rathindra Bose on Wednesday (June 3, 2026). Ritabrata Banerjee had claimed that he has the support of 60 MLAs and the number will increase in the coming days.</p>
<p style="text-align: justify;"><strong>Abhishek Banerjee got Mamta&#8217;s support</strong></p>
<p style="text-align: justify;">After getting recognition as the Leader of Opposition, Ritabrata Banerjee had made it clear that Abhishek Banerjee would have no role in the party. He had said, &#8216;Our party has no relation with him. Our community also has no connection whatsoever with them. If there was a relationship, they would not have remained hidden for 26 days, but would have come out. He was beaten the way thieves are beaten. However, Abhishek Banerjee was also present in the meeting held at Mamata Banerjee&#8217;s house, when there was talk of going to the High Court against the LOP. It is clear from this that Mamata Banerjee is completely with Abhishek Banerjee.</p>
<p style="text-align: justify;">This means that the core faction of the Trinamool Congress, which still owes its allegiance to former West Bengal Chief Minister Mamata Banerjee and her nephew and party general secretary Abhishek Banerjee, is now reduced to only 20 MLAs. The results of the assembly elections were declared on May 4, in which the Trinamool Congress had to face a crushing defeat. Trinamool Congress&#8217;s number of seats in the 294-seat West Bengal Assembly had reduced to 80.</p>

<p style="text-align: justify;">OBC reservation has always been a big and controversial issue in the politics of West Bengal, but now it has taken a historic turn. Chief Minister Suvendu Adhikari has reduced the state&#8217;s OBC reservation from 17 percent to 7 percent. The most shocking thing is that under this decision, OBC reservation for Muslim communities has been completely abolished. The government has restored the original OBC list before 2010, which included only 66 castes and these castes will now get only 7 percent reservation. This decision was taken after the first cabinet meeting of the new government and with this the OBC categories (OBC-A and OBC-B) created on the basis of religion in the state have been completely abolished. <em><strong>What is this whole matter after all?</strong></em></p>
<p style="text-align: justify;"><strong>What was the system before 2010?</strong></p>
<p style="text-align: justify;">Till 2010, West Bengal&#8217;s OBC list included only 66 castes, which were created entirely on the basis of social and economic backwardness. This list was prepared after many years of study and recommendations of the Commission and genuine backward class communities were included in it.</p>
<p style="text-align: justify;"><strong>How did Left Front and Trinamool change the equations after 2010?</strong></p>
<p style="text-align: justify;">After this the political game started. In September 2010, just before the assembly elections, the Left Front government included 42 new castes in the OBC list and also divided the reservation into two categories: 10% reservation for Category-A (extremely backward) and 7% for Category-B (backward).</p>
<p style="text-align: justify;">After coming to power in May 2012, Mamata Banerjee&#8217;s Trinamool Congress government took it further and added 35 more castes to the OBC list. Together, these two governments included a total of 77 new castes in the OBC list, out of which 75 belonged to the Muslim community. In this way, OBC reservation in the state became 17% (10% for Category-A and 7% for Category-B) and about 80% of the Muslim population of the state came under this reservation.</p>
<p style="text-align: justify;"><strong>How did Calcutta High Court catch this &#8216;game&#8217;?</strong></p>
<p style="text-align: justify;">The biggest turning point in this entire matter came on 22 May 2024, when the Calcutta High Court gave a historic verdict. The bench of Justice Tapabrata Chakraborty and Justice Rajashekhar Mantha canceled the reservation of 77 castes included in the OBC list after 2010, terming it illegal and unconstitutional.</p>
<p style="text-align: justify;">The court said in its decision, &#8216;Religion is the only criterion for declaring these communities as OBC.&#8217; The court also said that this reservation was given for political purposes, which is an insult to democracy and the entire community. Not only this, the court clarified that the OBC status given to the communities was given in a hurry because it was an election promise of Mamata Banerjee and unconstitutional method was adopted to fulfill it as soon as she gained power.</p>
<p style="text-align: justify;">Due to this decision, about 12 lakh OBC certificates issued after 2010 were cancelled. However, the court also made it clear that the services of those who have already taken advantage of this reservation and got jobs will not be affected by this decision.</p>
<p style="text-align: justify;"><strong>Mamata Banerjee&#8217;s protest and legal battle</strong></p>
<p style="text-align: justify;">Mamata Banerjee took a very strict stand against the decision of the High Court. She said, &#8216;I will not accept this order of the court, I will not accept it, I will not accept it&#8230;&#8217; Her government challenged this decision in the Supreme Court. There was a period of legal turmoil in the Supreme Court. First, the Supreme Court stayed the High Court order and allowed the state government to implement the 17% OBC quota. But in August 2024, Justice Kaushik Chanda of Calcutta High Court ordered in a JEE case that only the old OBC quota formula of 2010 (7%) will be applicable. After this, the Supreme Court bench of three judges gave permission to the state government to implement the 17% quota.</p>
<p style="text-align: justify;"><strong>What did Shubhendu government do now?</strong></p>
<p style="text-align: justify;">After the change of power in the 2026 assembly elections, the first major decision taken by the BJP government led by Chief Minister Suvendu Adhikari was regarding OBC reservation. The government took 5 big steps:</p>
<ol>
<li style="text-align: justify;"><strong>Petition withdrawn:</strong> First of all, the new government withdrew the petition filed by the Mamata Banerjee government in the Supreme Court, in which the High Court&#8217;s decision was challenged.</li>
<li style="text-align: justify;"><strong>Old list restored:</strong> On May 19, 2026, the Backward Classes Welfare Department issued a notification restoring the pre-2010 OBC list, which included only 66 castes.</li>
<li style="text-align: justify;"><strong>Reservation reduced:</strong> Total OBC reservation was reduced from 17% to 7%.</li>
<li style="text-align: justify;"><strong>Religion-based categories eliminated:</strong> The religion-based categories of OBC-A and OBC-B were completely abolished.</li>
<li style="text-align: justify;"><strong>Muslim community out:</strong> The new list removed 74 sub-castes, most of which were Muslims. Now only three Muslim communities – Pahadia, Hajjam and Chaudali are included in the OBC list.</li>
</ol>
<p style="text-align: justify;">Apart from this, many traditional and social communities like Kapali, Kurmi, Barber (Nepit), Tanti, Dhanuk, Butcher, Khandait, Turha, Paharia Muslim, Devanga, Hajjam (Muslim), Goala, Sutradhar, Karmakar, Swarnakar etc. are included in the new list.</p>
<p style="text-align: justify;"><strong>How big is the impact of this decision?</strong></p>
<p style="text-align: justify;">This decision can have 4 major impacts:</p>
<ul>
<li style="text-align: justify;"><strong>Affected Certificates:</strong> After the High Court&#8217;s decision, about 12 lakh OBC certificates issued after 2010 were cancelled.</li>
<li style="text-align: justify;"><strong>Beneficiary: </strong>Under the previous system, about 80% of the Muslim population of the state used to get the benefit of OBC reservation, which will now end.</li>
<li style="text-align: justify;"><strong>Impact on education:</strong> After the new notification, the Education Department has increased the OBC quota to 7% in the centralized admission portal. “We are following the state order in all matters of admission and establishment,” said Debajyoti Konar, registrar of Presidency University.</li>
<li style="text-align: justify;"><strong>Socio-Economic Impact:</strong> Experts believe that this decision will bring a big change in the caste equations in the state. OBC researchers say that there was a slight improvement in the presence of Muslims in jobs like higher education, police force and teaching, but now they will have to fight in the general category, due to which their representation may fall rapidly.</li>
</ul>
<p style="text-align: justify;">On this, Suvendu government says that this decision has been taken in compliance with the order of Calcutta High Court of May 2024. The government argues that previous governments included Muslims in the OBC list for &#8216;vote bank politics&#8217;, due to which the genuinely backward Hindu communities were deprived of the benefits of reservation.</p>
<p style="text-align: justify;">At the same time, TMC has described this decision as &#8216;anti-Muslim&#8217; and &#8216;against social justice&#8217;. BJP has called it &#8216;end of appeasement politics&#8217;.</p>
<p style="text-align: justify;">Former top civil servant and expert Jawahar Sarkar said the impact of a large number of Muslims being left out of the OBC list is likely to be more political than socio-economic.</p>
<p style="text-align: justify;"><strong>Political issue is bigger than reservation</strong></p>
<p style="text-align: justify;">This whole matter is not just about reservation, but about politics. In 2010, the Left Front and in 2012, TMC included Muslim communities in the OBC list for electoral gains. In 2024, the Calcutta High Court declared it unconstitutional. The new BJP government made this its election promise in 2026 and implemented it as soon as it came to power.</p>

<p style="text-align: justify;">The stir has intensified after the assembly elections in West Bengal. Now Trinamool Congress has moved the Supreme Court against the Election Commission&#8217;s decision to appoint only central employees or PSU employees as counting supervisors. The ruling party of Bengal (TMC) has cited the seriousness of the matter while demanding an immediate hearing. </p>
<p style="text-align: justify;">Tomorrow, on May 2, the Supreme Court has formed a special bench to hear TMC&#8217;s petition against the order of the Calcutta High Court in which its petition was rejected. In this petition, a challenge was made to deploy only Central Government and PSU (Public Sector Undertaking) employees as supervisors in the counting of votes in the West Bengal Assembly elections. The bench of Justice PS Narasimha and Justice Joymalya Bagchi will hear the application tomorrow at 10:30 am.</p>
<p style="text-align: justify;"><strong>Calcutta High Court had rejected the petition</strong></p>
<p style="text-align: justify;">TMC had earlier moved the Calcutta High Court against deploying only central government and central public sector employees as counting supervisors and assistants at the counting centres. Where his petition was rejected on 30 April.</p>
<p style="text-align: justify;">The High Court said in its order, &#8216;It is the prerogative of the Election Commission to appoint counting supervisors and counting assistants from among the state government or central government employees. The court does not find any illegality in the appointment of Central Government or Central PSU employees instead of State Government employees.</p>
<p style="text-align: justify;">The court had also said that the instructions issued by the Additional Chief Electoral Officer of West Bengal were issued to ensure transparency, fairness and orderly conduct of the vote counting process and it is part of the election process.</p>
<p style="text-align: justify;"><strong>Counting of votes will take place in West Bengal on May 4. </strong></p>
<p style="text-align: justify;">TMC MP and senior lawyer Kalyan Banerjee and advocate Biswaroop Bhattacharya had filed public interest litigation in the Calcutta High Court. Kalyan Banerjee had alleged that the Election Commission was appointing only central employees as observers at the counting centres, whereas such a decision cannot be taken unilaterally. He had sought intervention from the court. Counting of votes for West Bengal Assembly elections will take place on May 4. Before this, political controversy has intensified in the state regarding the vote counting system.</p>

<p style="text-align: justify;">In view of the lack of trust between the West Bengal government and the Election Commission, the Supreme Court has directed to appoint a judicial officer for the Special Intensive Revision (SIR) process. The court asked the Calcutta High Court to appoint judicial officers to decide on the claims and objections in the SIR. The court has said that these officers should be spotless and should be of the rank of District Judge and Additional District Judge.</p>
<p style="text-align: justify;">On Friday (February 20, 2026), the Bengal government and the Election Commission were seen accusing each other in front of the bench of Chief Justice Surya Kant and Justice Joymalya Bagchi. Bengal government&#8217;s lawyer Shyam Diwan said that the Election Commission has now appointed another new type of officers. They are being called Special Role Officers, this special officer is even higher than the Electoral Registration Officer (ERO).</p>
<p style="text-align: justify;">On this argument of Shyam Diwan, CJI Surya Kant said, &#8216;It seems that we will have to appoint judicial officers or IAS from other cadre. The Chief Justice of the High Court will have to be asked to appoint judicial officers with good records.</p>
<p style="text-align: justify;">Senior advocate DM Naidu, appearing for the Election Commission, told the court that West Bengal has not provided qualified officers to the Commission. On this the CJI expressed disappointment and said that we were expecting a cooperative attitude from the state government. In the hearing on February 9, the court had directed the Bengal government to provide Class 2 officers. Even then the court had reprimanded the state government as to why officers were not made available despite giving orders in the last hearing.</p>
<p style="text-align: justify;">Senior advocate Kapil Sibal said during this time that the court had ordered that the date of scrutiny of documents is being extended from February 14 to February 21, but the Election Commission has stopped uploading the documents from February 15. The CJI told him that he would seek information from the Election Commission on his order of that day and its implementation. The court asked the status of the SIR, on which Kapil Sibal said that there are still 48 hours in it and he is raising some issues.</p>

<p style="text-align: justify;">A hearing was held in the Calcutta High Court on Wednesday (January 14, 2026) in the case of Enforcement Directorate (ED) raid on the house of political consultancy firm I-PAC and its co-founder Prateek Jain. Additional Solicitor General SV Raju appeared on behalf of ED. During the hearing, he got angry when his mike was switched off.</p>
<p style="text-align: justify;">According to Bar and Bench report, today&#8217;s hearing was held before Justice Surva Ghosh through video conferencing. During the hearing, ASG SV Raju said that someone was doing mischief, his mike was going off again and again. Justice Ghosh also expressed displeasure over this.</p>
<p style="text-align: justify;">ASG SV Raju said, &#8216;Someone is doing mischief. I have appeared on behalf of the Central Investigation Agency. I am Additional Solicitor General. I have not completed my arguments. There is something wrong, my mic gets muted again and again. Justice Surva Ghosh expressed displeasure at this and said, &#8216;Let me hear him.&#8217;</p>
<p style="text-align: justify;">On January 8, ED had raided the house of political consultancy firm I-PAC and Prateek Jain and suddenly West Bengal Chief Minister Mamata Banerjee reached there along with senior officers. Today the High Court was hearing the petition of Trinamool Congress, in which it has demanded protection of its political data. However, ED says that it has not seized any documents in the raid, on the contrary, Mamata Banerjee left from there with the files.</p>
<p style="text-align: justify;">The High Court rejected the petition of TMC and said that the Enforcement Directorate has stated on the basis of its Panchnama that the investigating agency has not seized any document during the raid, in such a situation the petition filed by the Trinamool Congress has no meaning, because the apprehension was expressed by the Trinamool Congress that the data collected by the Enforcement Directorate can be used politically.</p>

<p style="text-align: justify;">The Calcutta High Court has stayed the new OBC reservation list presented by the Trinamool Congress (TMC) government on Wednesday (June 18, 2025). BJP leaders welcomed this decision and distributed sweets in the assembly. At the same time, CPI (M) has also surrounded the Mamta government on this matter.</p>
<p style="text-align: justify;">Leader of Opposition in the Bengal Legislative Assembly Suvendu Adhikari on Wednesday posted on X and said that I express my heartfelt gratitude to the Hon&#8217;ble Calcutta High Court for my historic decision to stop the inclusion of 76 Muslim classes in the new OBC list prepared by the Mamata Banerjee government. This is a wonderful victory of the judiciary against an arrogant state government. </p>
<p style="text-align: justify;"><strong>&#8216;Mamta government sidelined qualified Hindu and other non-Muslim communities&#8217;</strong><br />He said that the politics of tremendous appeasement of TMC government, about 90 percent of the Muslim communities in the updated new OBC list is clear. Before TMC came to power in 2010, only 20 percent of the OBC communities were Muslims. Under the rule of Mamta Banerjee, this number has touched the sky, bypassing qualified Hindus and other non-Muslim communities. </p>
<p style="text-align: justify;"><strong>CPI (M) leader also targeted Sujan Chakraborty</strong><br />CPI (M) Central Committee member Sujan Chakraborty also targeted the Mamta government in a press conference. He said that the state government is continuously misleading people on OBC reservation. The High Court had earlier canceled the OBC list. Instead of rectifying the process, the government has repeated the same mistakes. This is nothing but trying to mislead the people of Bengal. </p>
<p style="text-align: justify;"><strong>TMC leader told BJP anti -OBC party</strong><br />After this decision of the High Court, BJP leaders distributed sweets in the assembly. Regarding this, TMC leader Kunal Ghosh said that BJP is an anti -OBC party. Here the conspiracy of opposition leaders should be seen. We trust the judiciary, but we should also pay attention to who were the people behind it. We have seen that people who made big statements on recruitment in this High Court separated to become BJP MPs. Now they want to harm OBCs and create disturbance. </p>
<p style="text-align: justify;">A few days after Chief Minister Mamata Banerjee has placed a revised list before the Assembly, this order of the High Court has come. A division bench of Justice Tapabrata Chakraborty and Rajasekhar Mantha has ordered the government not to take any action on the basis of the list till 31 July. The government has been asked not to implement it till the next hearing.</p>
<p style="text-align: justify;">Earlier this month, the West Bengal government had issued a notification expanding the OBC list to include 76 additional sub-castes, causing the total number of communities to 140. There are 80 Muslim communities, while 60 are non -Muslims.</p>

<p style="text-align: justify;">Violence took place in many areas including Murshidabad in West Bengal over the Waqf law, in which 3 people have died and many have been injured. More than 150 people have been arrested in other violence cases including Murshidabad. In view of the violence, the Calcutta High Court has ordered the deployment of central security forces.</p>
<p style="text-align: justify;">In view of the violence in West Bengal, Union Home Secretary Govind Mohan spoke through a video conference with the Chief Secretary and DGP of the state on Saturday (April 12, 2025). In addition to about 300 BSF personnel in the violence affected Murshidabad, 5 more companies have been deployed. </p>
<p style="text-align: justify;"><strong>Complete development so far regarding Murshidabad violence </strong><br />Violence erupted in Malda, Murshidabad, South 24 Parganas and Hooghly districts on 11 April 2025 over the new Waqf law and several vehicles including police vans were set on fire. So far 3 people have died during clashes in violence affected areas of Murshidabad district. 2 people died in Shamsherganj and 1 died in Murshidabad Medical College. </p>
<p style="text-align: justify;"><strong>What did the Calcutta High Court say?</strong><br />Leader of Opposition in Bengal Assembly Suvendu Adhikari filed a petition in the High Court on Saturday demanding the deployment of central forces in violence -prone areas. The petition was heard in the special bench of Judge Samen Sen and Judge Raja Basu Chaudhary. The bench said that the court cannot sit with eyes closed. Return peace in Murshidabad and protecting everyone is the main objective of the court. The High Court has ordered the deployment of central security forces in the violence affected areas.</p>
<p style="text-align: justify;"><strong>What did the DGP of West Bengal say?</strong><br />The DGP of West Bengal said that the situation is tense, but is under control and it is being monitored strictly. The DGP also said that he is taking help of BSF posted locally and more than 150 persons have been arrested.</p>
<p style="text-align: justify;"><strong>Abhishek Banerjee accused BJP</strong><br />Senior Trinamool Congress (TMC) leader Abhishek Banerjee on Saturday alleged that a section of opposition forces failed to gain power in a democratic manner, trying to create unrest in West Bengal. After failing to derail the initiative of development in Bengal under the leadership of Mamta Banerjee, these people are now playing satanic games.</p>
<p style="text-align: justify;"><strong>Bengal BJP president&#8217;s big statement</strong><br />Bengal BJP president Sukant Majumdar alleged that Mamta regime is sitting blind despite attacks on Hindus in Shamsherganj, Sati and Jangipur. Majumdar said that such vandalism and hooliganism done by a section of minorities will be stopped and crushed in 5 minutes when the BJP comes to power in the state.</p>
<p style="text-align: justify;"><strong>&#8216;BJP leaders want to riot before Bengal elections&#8217; </strong><br />TMC MLA Madan Mitra said that BJP leaders want to commit violence in Bengal by speaking directly. What is a little such violence is in all the states, it is the responsibility of the central government which is bringing such a law of Waqf. Before the 2026 Bengal elections, BJP leaders want to riot and want to fight with Pakistan. Amit Shah, Modi and Yogi are responsible for whatever rioting is going on in the country.</p>
<p style="text-align: justify;"><strong>&#8216;Conspiracy to separate Murshidabad from West Bengal&#8217; </strong><br />BJP leader Dilip Ghosh said in a conversation with news agency ANI, &#8220;There is a conspiracy to separate Murshidabad district from West Bengal. There is arson and sabotage in Hindu areas. Hindus have been murdered, yet the DGP of Bengal is saying that nothing has happened &#8216;.</p>
