Mamata Banerjee Refuses Resign: After the crushing defeat in the West Bengal Assembly elections, Chief Minister Mamata Banerjee’s statement of not resigning has intensified the constitutional debate along with political turmoil. In fact, in the election results in West Bengal, Bharatiya Janata Party has got a clear majority while Trinamool Congress is left behind. After the defeat of Trinamool Congress, Mamata Banerjee has clearly said that she will not step down from the post at all. In such a situation, the big question arising is whether a Chief Minister can continue in office even after defeat and if he does not resign, then any legal action can be taken against him. So let us tell you today that if Mamata Banerjee does not resign, a case can be filed against her and what the rules say about it.

What does the Constitution say?

According to the Indian Constitution, the Chief Minister and his Council of Ministers hold office during the pleasure of the Governor. That is, the government can run only as long as the Governor has the trust and there is majority in the Assembly. As soon as the majority ends, the legal basis for the Chief Minister to continue in office also becomes weak. Constitutional experts say that the Chief Minister’s continuation in office after the election defeat can only be a formal situation. Until a new government is formed. This is considered a caretaker role, in which major policy decisions are not taken.

What can happen if you do not resign?

According to experts, if a Chief Minister refuses to resign, then the Governor has many options. Like the Governor can dismiss the Chief Minister from the post. The party with the new majority can be invited to form the government or, if necessary, it can be asked to prove majority in the Assembly. If the situation becomes more complicated and there are obstacles in government formation, then considering it a success of the constitutional machinery, President’s rule can also be recommended.

Can a case be filed against Mamata Banerjee?

Legal experts say that no criminal case is registered directly just because of not resigning. This matter is more related to the constitutional and political process. However, if a Chief Minister starts taking decisions ignoring the constitutional rules, then the situation can become serious and the Central Government or the Governor can intervene.

India has welcomed the formation of the new interim government under the leadership of former Chief Justice Sushila Karki in Nepal on Saturday (September 13, 2025). Karki was sworn in as the country’s first woman Prime Minister late on Friday night.

The Ministry of External Affairs (Mea) said in a statement, “We welcome the formation of a new interim government in Nepal under the leadership of Sushila Karki. We hope that it will promote peace and stability.” It was further said, “As a close neighbor, a democratic country and a long -term development partner, India will continue to work closely with Nepal for the good and prosperity of its two countries, people.”

President Ramchandra Paudel administered the oath

73 -year -old Karki has taken over in view of KP Sharma Oli’s resignation in view of the political uncertainty that lasted for several days. President Ramchandra Paudel administered the oath of Prime Minister to Karki at the President’s residence in Kathmandu. Chief Justice of Nepal, senior officials, head of security and several diplomats were present at the ceremony.

Nepal’s new PM has read from BHU

President Paudel said that Karki -led acting government has the right to hold parliamentary elections within 6 months. Karki, known for his honesty as the Chief Justice, has been selected after a conversation between the President, the military leadership of Nepal and the leaders leading the mass movements. Karki, who studied at Banaras Hindu University, has long been considered one of the most respected personalities of Nepal.

Oli, a supporter of China, had to resign

After resigning from the post of Prime Minister, KP Sharma Oli has made serious allegations against India. Describing myself as stubborn, he said that if I was not adamant on issues like Ram’s birth place, Lipulekh and Kalapani in Ayodhya, India, then I could get many more benefits, but I have no greed for the post. Let us know that Oli has been considered a supporter of China and after becoming Prime Minister, his first visit was from India instead of India.
