Hemant Malaviya, who has made abusive cartoons about the Prime Minister and posting on social media, has said to remove his controversial post. In view of this, the Supreme Court has said that it will consider Malaviya’s anticipatory bail plea on Tuesday (July 15, 2025). In the hearing held on Monday, the judges called Hemant’s attitude immature and inflammatory.

On July 8, Indore Bench Justice Subodh Abhikar of Madhya Pradesh High Court rejected Hemant’s anticipatory bail plea. The High Court had lashed out at the petitioner for making indecent cartoons of RSS workers, Prime Minister and other people and comments about Lord Shiva. The judge had said that Hemant has misused freedom of expression.

On Monday, July 14, the bench of Justice Sudhanshu Dhulia and Justice Arvind Kumar heard the petitionist’s petition. Advocate Vrinda Grover said that the original post about the Prime Minister was done in 2021. It was a satire about the covid vaccine. In May this year, a Facebook user posted it again with indecent remarks. Hemant shared it. Based on this, this FIR has been done.

The judges said that cartoonists and comedians also need to pay attention to their conduct. The petitioner in this case is over 50 years of age, but his attitude is not mature. Vrinda Grover said that the social media posts were going to look rigid and unpleasant. The cartoonist will remove him from his social media account.

Additional Solicitor General KM Natraj, presented for the Madhya Pradesh government, opposed the anticipatory bail plea. He said that the crime will not end by removing the post. After a brief hearing, the Supreme Court postponed it for the next day.

An FIR was lodged against Hemant Malaviya in May this year by RSS worker and lawyer Vinay Joshi of Indore at Lasudia police station. It was said in the FIR that Hemant has tried to hurt the religious sentiments of Hindus by putting objectionable material and spoil social harmony.

Along with making unfair remarks about Lord Shiva, Hemant Malaviya, the Rashtriya Swayamsevak Sangh (RSS) leaders and Prime Minister Narendra Modi’s objectionable cartoon, has approached the Supreme Court. Hemant has demanded anticipatory bail. The Supreme Court has said to hear his petition on Monday.

On July 8, Hemant’s plea was dismissed by Justice Subodh Abhyankar of Indore Bench of the High Court. RSS workers, Prime Minister and other people’s indecent cartoon and comment about Lord Shiva were considered by the High Court misuse of freedom of expression.

On behalf of the cartoonist, lawyer Vrinda Grover put the case in front of the bench of Justice Sudhanshu Dhulia and Justice Joyamalya Bagchi. He said that a case has been registered for cartoons posted in 2021. The section of BNS which is imposed in the FIR, is sentenced to 3 years. Nevertheless, the High Court refused anticipatory bail.
