Rajpal Yadav had taken a loan of Rs 5 crore from Murali Projects Private Limited in the year 2010 for the direction of the film ‘Ata-Pata Lapata’. The film had flopped. Rajpal Yadav could not pay the money. In this case, this amount along with interest increased to Rs 9 crore. The checks given by Rajpal Yadav to the company had bounced. In 2018, Karkardooma Court of Delhi sentenced him to 6 months in jail.

After this Rajpal Yadav appealed in the High Court. Rajpal Yadav got relief many times. Then in February 2026, the Delhi High Court rejected Rajpal Yadav’s application seeking more time to clear the dues. After this Rajpal surrendered in Tihar Jail. The actor got bail in this case on 17 February.

Can a case be filed if a gift check bounces?

If we talk about it, the direct answer would be no. If you have given a check to someone for a wedding, festival, charity or any personal help and it bounces, then generally a criminal case is not made out under Section 138.

Gifts are not considered a legal obligation.
That is why not every gift check becomes a bounce case.

Know when such cases have come up

In the year 2013, the case of Vijay vs. Laxman came up in the Supreme Court. In this case, complainant Vijay claimed that he had given a personal loan of Rs 1 lakh 15 thousand to Laxman (accused). Laxman gave a check to repay this loan, which when deposited in the bank bounced due to lack of money. Laxman said that he had not taken any loan. He had given this check to Vijay’s father only as security, because he used to supply milk there.

What was CART’s decision?

The Supreme Court found that Vijay could not prove when and how he had given the loan. On which the court said that having the check in hand does not prove that the loan is legally valid, after which the court acquitted Laxman and dismissed Vijay’s complaint.

A similar case came in Andhra Pradesh High Court

Another such case came in Andhra Pradesh High Court, the case of B. Krishna Reddy vs. M. Chandrasekhar. In this case also the complainant could not prove the loan. After which the court clearly said that if the check is given as a gift or any personal help then it cannot be considered a check bounce crime.

Under Section 139, the court initially assumes that the check was given for some liability. In such a situation, you may have to prove such as…

• The check was given as a gift.
• There was no loan.
• And also the other person’s claim was wrong.

• Before giving the cheque, write the reason on it like wedding gift or festival gift.
• Keep a gift letter. If the size is small then definitely give a written note.
• Keep its records safely like messages, chats or letters can become evidence.

Delhi High Court reserved its verdict in the check bounce case filed against Bollywood actor Rajpal Yadav. This case was filed by the company Murali Project Private Limited. During the hearing, the court also expressed displeasure over the changing attitude of the actor. Justice Swarn Kanta Sharma, who was hearing the case, clearly said that if a judge behaves politely, it does not mean that he should be considered weak.

Rajpal Yadav asked the court for 30 days time to repay Rs 6 crore but the court rejected this demand. The judge clearly said, ‘No means no.’ Now I am reserving the decision and will not be given time.

Rajpal Yadav has been punished before also
In fact, in May 2024, a sessions court had convicted Rajpal Yadav in the check bounce case and sentenced him to six months in jail. Later, Delhi High Court had stayed his sentence because his lawyer had assured the court that both the parties would resolve the dispute through mutual agreement. To resolve the matter, it was also sent to the Mediation Center of Delhi High Court. But according to the court, despite giving time and assurance several times, the actor did not pay the fixed amount.

For this reason, in February 2026, the court ordered him to surrender before the jail authorities. Rajpal Yadav surrendered on 5 February and remained in jail for some time. Later, when he deposited Rs 1.5 crore with the complainant, the court put an interim stay on his sentence.

Advocate Avneet Singh Sikka, appearing for the complainant company, told the court that the actor has not paid approximately Rs 10 crore. According to him, about Rs 2 crore has already been paid to the trial court, but about Rs 7.75 crore is still outstanding. The lawyer also said that just by serving a jail sentence, a person’s financial responsibilities do not end. Therefore the company had filed a case under Section 138 of the Negotiable Instruments Act.

Court suggested the path of compromise
During the hearing, Delhi High Court also suggested the option of compromise to both the parties. The judge asked whether the dispute could be ended by taking a lesser amount. On this, the complainant’s lawyer said that if Rs 6 crore is given then the company can consider the settlement. Rajpal Yadav, who participated in the hearing through video conference, said that he will follow every order of the court. He said, ‘There is no problem in getting punished for my mistake. I will agree to whatever the court asks me to pay. However, he also claimed that he has suffered huge financial loss in this matter. Rajpal Yadav said that Rs 17 crore had been taken from him and he had to sell five of his flats.

However, when Rajpal Yadav asked for 30 days time to pay Rs 6 crore, the court did not approve it. The date of agreement could not be decided. After which Delhi High Court reserved its decision in the case.
