The Enforcement Directorate (ED) has summoned the BJP worker from Karnataka, who has filed a petition in the Allahabad High Court claiming Rahul Gandhi being a British citizen. Official sources gave this information on Saturday (September 6, 2025).

Identification of BJP worker S. Vignesh is in the form of Shishir. He has been asked to appear before the Central Investigation Agency on 9 September. ED sources said that Shishir has been asked to appear with all the evidence and documents related to the case under the provisions of the Currency Management Act (FEMA). He informed that these allegations are being investigated.

Congress did not react
Under FEMA, ED examines complaints related to violations of foreign exchange laws regarding individuals and companies. When a response was sought from the Congress party on the matter, he refused to comment.

In the PIL filed in the Allahabad High Court, Shishir claimed that he has some documents and e-mails of the British government, which proves that the Leader of the Opposition in the Lok Sabha Gandhi is a UK citizen and is disqualified to contest elections in India for this reason. On August 30, the Lucknow bench of the Allahabad High Court ordered the Central Government to provide 24 -hour security to Shishir.

He also claimed that he has appeared before the agency in Delhi several times and has also given evidence related to Rahul Gandhi’s alleged British citizenship. The High Court has fixed the next hearing of the case for October 9.

During the last hearing of the case, the Central Government had told the court that the Government of India has written a letter to the UK government to provide details related to British citizenship of Rahul Gandhi.

The US Supreme Court on Friday (June 27, 2025) has given a major victory to the President by curbing the power of federal judges to prevent the executive actions of Donald Trump.

With a 6-3 decision regarding Trump’s attempt to end congenital citizenship, the court said that the nationwide prohibition issued by the judges of the District Court is more than the just rights given by the Congress to the federal courts.

According to the AFP report, the US Supreme Court did not immediately pronounce the decision on the constitutionality of Trump’s executive order seeking abolition of citizenship for children born on American soil, but in the realm of judicial matters, the decision will remove a major obstruction for Trump’s often highly controversial orders and will increase the power of the White House further.

Justice Amy Koni Barrett said that the federal courts do not normalize the executive branch, but they resolve matters and disputes according to the rights given to them by the Congress. He said that when a court concludes that the executive branch has worked illegally, it does not mean to encroach its power for the court.

The case was clearly about the executive order signed by Trump on the first day of his term, in which the birthright was abolished.

During the debate before the Supreme Court in May, both conservative and liberal judges had expressed concern about the increasing use of nationwide prohibitory orders on behalf of the District Courts in recent years.

The legal basis of OCI cancellation and the attitude of the Government of India
According to the Government of India, it has the right to cancel OCI under Article 7B and OCI Act 2005 of the Constitution.
