Justice BR Gavai has now retired after assuming the post of Chief Justice of India (CJI). The new CJI Surya Kant has taken over. On this occasion, Justice Gavai spoke openly about his journey to the Supreme Court. He also responded openly to the speculations about joining politics after retirement. While being the Chief Justice of the Supreme Court, Justice Gavai has been involved in more than 330 decisions.

After retirement, Justice Gavai gave an interview to India Today. When asked, you had said that you will not take a job after retirement, so are there chances that you can enter politics? On this he said that at the moment I have not thought about it. I’m just at peace right now. I have decided not to do anything right now and believe that you should live as per today.

‘I will not accept any governor’s post’
He said, ‘As far as I feel, I will not accept the post of head of any tribunal. I will not accept any governor’s post. I will not even accept being nominated in Rajya Sabha. I am very clear about this.

CJI Surya Kant heard 17 cases on the first day
On his first day as Chief Justice of India, Justice Surya Kant set a new procedural benchmark on Monday (November 24). He said that for immediate listing the cases should be mentioned in writing. Oral requests will be considered in exceptional circumstances, such as in cases involving the death penalty and personal liberty. The bench led by CJI Surya Kant heard 17 cases for about 2 hours on the very first day.

Let us tell you that earlier, former Chief Justice Sanjiv Khanna had stopped the oral practice for immediate listing of cases in the apex court. However, Justice Gavai, who came to this post after Justice Khanna, started it again. Generally, sometimes lawyers mention the cases orally before the Chief Justice, so that they can be listed immediately.

Chief Justice of India (CJI) BR Gavai said that he follows Buddhism, but has not studied any religion in depth. Describing himself as completely secular, he said that he believes in all religions – Hindu, Sikh, Muslim, Christian.

Considered humanity and the Constitution above religion.
Speaking at a program, he told that he got this idea from his father, who was a follower of Dr. Bhimrao Ambedkar. Gavai said that whenever the family got information about any Dargah, they used to go there also.

CJI said before leaving the Supreme Court
This speech was given at the farewell ceremony organized by the Supreme Court Advocates-on-Record Association (SCAORA). CJI Gavai is retiring on 23 November and 22 November is his last working day in the Supreme Court.

What I am today is because of the Constitution and Dr. Ambedkar – BR Gavai
CJI Gavai, who comes from the Dalit community, said that his entire journey was possible because of the Constitution and Dr. Ambedkar. He said, ‘Whatever I am today is because of this institution (Supreme Court). A child who studied sitting on the floor in a municipal school could never have imagined that he would reach this far. I always tried to follow the four values of the Constitution – justice, liberty, equality and fraternity.

Supreme Court is not just an institution of CJI but of all judges – Gavai
Gavai said that the Supreme Court should not be an individual-centric institution. He said that I never took decisions alone. Every decision was taken with the participation of the full court and all the judges. The Supreme Court is a big institution and judges, lawyers, registry and staff are all equally important in it.

Mention of big decision on calling lawyers by investigating agencies
In the program, SCAORA President Vipin Nair thanked CJI Gavai for taking cognizance of the issue of lawyers being summoned by the investigating agencies. In an important decision of October 31, the Supreme Court had said that agencies like ED cannot summon lawyers on the basis of their legal advice.

Incoming Chief Justice of India Surya Kant called on members of the legal fraternity to be sympathetic towards those seeking justice and emphasized that both the bar and the bench have equal responsibility in the administration of justice.

Bar is the first step to get justice: Justice Surya Kant
While addressing as the chief guest at the 125th Foundation Day function of Avadh Bar Association organized in the auditorium of the High Court located at Gomti Nagar, Justice Surya Kant said that the first step to get justice for the weak and poor people is the Bar. He said, ‘Whoever comes to the court in the hope of justice, he first approaches the lawyer. Therefore the Bar should understand the pain of the poor. The Bar and the Bench have equal responsibility in the administration of justice.

Challenges of justice system in the era of AI
Referring to the changing times and new technological challenges, Justice Surya Kant said, ‘The era of AI has arrived, the country is progressing economically. In such a situation, the number of commercial cases will increase, for which we will have to be prepared. He described India’s judicial system as one of the best judicial systems in the world. Recalling his days as a lawyer, he said that he had received invaluable guidance from the senior members of the Lucknow bench of the Allahabad High Court. He described the relationship between the Bar and the Bench as an unbreakable one.

Role and responsibilities of lawyers
Chief Justice of Allahabad High Court Justice Arun Bhansali said, ‘White shirt, black coat and gown are not just a uniform, but a belief.’ He urged the lawyers to explain the legal proceedings in simple language so that the client can understand it easily. Delhi High Court Chief Justice Devendra Kumar Upadhyay said the legacy of the Awadh Bar has been glorious, having given the state two chief ministers, Shripat Mishra and C.P. Gave Gupta. He also said that a member of the Awadh Bar became the first Attorney General of Pakistan and his son later became the Chief Justice of the Supreme Court of Pakistan.

Providing justice is the priority of lawyers: Judge
Justice Rajan Rai, senior judge of the Lucknow bench, said that the members of the bar should listen to the voice of the poor section and providing justice in the legal profession should be their first priority. Justice Mahesh Chandra Tripathi said, ‘A strong bar is the hallmark of a strong judiciary.’ The program was organized by Awadh Bar Association President S. Chandra and general secretary L.K. Tiwari also addressed.

The country will get a new Chief Justice on 24 November. President Draupadi Murmu has approved the recommendation to appoint Justice Surya Kant, the second senior most judge of the Supreme Court, to this post. On October 27, the current Chief Justice BR Gavai had recommended the name of Justice Kant as his successor to the Central Government.

Chief Justice Gavai is retiring on 23 November. In such a situation, Justice Kant will take oath of office on 24th November. His tenure will be till February 9, 2027 i.e. about 15 months. He will be the first Chief Justice of the Supreme Court to come from Haryana.

Became Supreme Court judge in 2019

Justice Surya Kant was born on 10 February 1962 in Hisar, Haryana. Justice Surya Kant, coming from a middle-class family, became the Advocate General of Haryana in the year 2000. In 2004, he was appointed judge of Punjab and Haryana High Court. In 2018, he became the Chief Justice of Himachal Pradesh High Court and on 24 May 2019, he became the Judge of the Supreme Court.

liberal attitude in court

As a judge, Justice Surya Kant, who has more than two decades of experience, expresses his views vocally in the court. Along with this, he also gives full opportunity to all the lawyers to present their views. His attitude is particularly lenient towards the parties appearing in person in the court. He is often seen listening to their problems like a family member and suggesting solutions.

Notice not issued on insult to CJI

Recently, he showed generosity by refusing to issue a contempt notice to the lawyer who threw a shoe at Chief Justice BR Gavai. He said that the court does not want to give importance to that lawyer by taking further action against him.

Hearing of many big cases including Bihar SIR

He has heard many important cases in the Supreme Court. Even at this time, he is hearing many important cases including Bihar SIR (Voter List Revision), Shiv Sena election symbol dispute, expulsion of illegal infiltrators and digital arrest.

Chief Justice of India (CJI) Bhushan R. Gavai has recommended the Central Government to appoint Justice Surya Kant as the next Chief Justice. Justice Surya Kant, the second most senior judge of the Supreme Court after the current CJI, can take charge as the 53rd CJI of the country on November 24.

CJI Gavai will retire on 23 November. According to sources, Justice Gavai, who took oath as the Chief Justice on May 14 this year, has recommended the name of Justice Surya Kant to the Union Law Ministry as the next Chief Justice. Justice Surya Kant’s tenure as CJI will be more than one year and two months. He will retire on 9 February 2027. Let us tell you that the retirement age of Supreme Court judges is 65 years.

CJI Gavai praised Justice Surya Kant
In his recommendation, CJI Gavai has described Justice Kant as suitable and capable to take charge in all aspects. He also said that both have similar social background, which is full of determination and struggle. Gavai said, “Like me, Justice Kant also comes from a section of the society that has seen struggle at every level of life, which makes me believe that he will be best suited to understand the pain and suffering of those who need the judiciary to protect their rights.”

Who is Justice Surya Kant
Born on 10 February 1962 in Hisar, Haryana, Justice Surya Kant’s rise to the highest position in the judiciary reflects his academic excellence and administrative skills. Justice Surya Kant, a Hisar graduate, obtained his law degree from Maharishi Dayanand University, Rohtak in 1984. He started his career from Hisar District Court before moving to Punjab and Haryana High Court in 1985.

He has expertise in constitutional, service and civil matters. His legal understanding and balanced advocacy have given him the opportunity to represent many major public institutions, including universities, boards and banks. In the year 2000, at the age of just 38, he became the youngest Advocate General of Haryana. An achievement that made him one of the most prominent legal figures in the state. The next year he was given the status of senior advocate.

All India Advocates Association, Bengaluru filed a complaint at the Vidhan Sabha police station against lawyer Rakesh Kishore, who threw a shoe at the Chief Justice (CJI) of the Supreme Court. The association has said that this is a serious crime and the accused should be punished. On the basis of the complaint, the police have registered zero FIR under sections 132 and 133 of the Indian Justice Code (BNS).

Lawyers demonstrated across the country

Lawyers from Delhi to different parts of the country protested against the attempt to misbehave with CJI BR Gavai. Lawyers said that this attack is not just on one person, but is a conspiracy to shake the foundation of India’s justice system. This is a direct attack against the Constitution.

The lawyer told why the attack was attempted?

Rakesh Kishore shouted, “Insulting Sanatan will not do” before trying to throw the shoe at the CJI. After this incident, lawyer Rakesh Kishore said, “I am against violence, but why did a non-violent, honest man, who has no case against him and is not associated with any group, have to do this, it is a matter of thought.”

He said, “I am hurt by the statement given by the CJI regarding Lord Vishnu. This was my reaction to his comment.” Advocate Rakesh Kumar said that he was not drunk that day and he has no regrets or fears about whatever happened.

License of lawyer Rakesh Kumar canceled

The Supreme Court Bar Association (SCBA) has canceled the license of accused lawyer Rakesh Kumar. On Monday (6 October 2025), the lawyer was taken into custody by the police after he tried to throw a shoe towards the CJI and was interrogated for 3 hours in the Supreme Court campus itself.
The sensation spread in the Supreme Court of the country on Monday (October 6) when a person threw a shoe at Chief Justice (CJI) BR Gawai. This incident happened for the first time in judicial history, which has shocked the entire country. On this, Leader of Opposition Tejashwi Yadav has reacted strongly and called it an attack on democratic values of India.

Tejashwi Yadav said in his statement that it is not just one person but an attack on the entire judicial system and constitution. He said that when the person sitting in the highest judicial post of the country has to face insults in the court, then it is a matter of concern. This is the same atmosphere that was spread in the country after 2014 under state protection, where hatred and violence were made normal.

Constitutional post in the country is also no longer safe- Tejashwi Yadav

RJD leader Tejashwi Yadav described the incident as a symbol of the Constitution and Babasaheb Bhimrao Ambedkar’s intolerance to the ideology. He said that the Chief Justice comes from the Dalit community and follows the spirit of the Constitution. If such individuals are not safe in constitutional positions, then this question is not only for the judiciary but for the whole country.

Why are the BJP who have anti-Dalit mentality now silent- Tejashwi Yadav

Tejashwi Yadav further said that this shoe has not been thrown on the Chief Justice, but on our Constitution and its author Baba Saheb Ambedkar. He alleged that people who spread hatred in the name of religion are now openly attacking the institutions of the country. Taking a dig at the BJP, he said that why the BJP holding the constitution and anti -Dalit mindset is silent on this incident. Do they find it all right? The dignity of the judiciary is the backbone of our democracy and it is the duty of every citizen to save it.

Democracy will be strengthened only when we respect his institutions

Tejashwi Yadav finally appealed to the countrymen to stand united against such trends which are weakening the constitution and the foundation of justice. He said that democracy will be strong only when we respect its institutions and maintain the dignity of the Constitution.

This incident has not only shocked the judicial world, but has also created a stir in the political corridors. The opposition has described it as a warning a threat to democracy, while a new debate has erupted on the security and dignity of the judiciary across the country.

Chief Justice (CJI) of India R. Gawai said on Friday (October 3) that the Indian judicial system is not operated by the rule of bulldozers, but from the rule of law. During an event in Mauritius, he mentioned his own decision to condemn Bulldozer Justice.

‘India does not run by law with bulldozers’

Highlighting the principle of rule of law and its widespread interpretation on behalf of the Supreme Court of India, CJI Gawai said, “This decision has given a clear message that the Indian judicial system is run not from the rule of bulldozers, but from the rule of law.”

Justice Gawai is on a three -day official visit to Mauritius. In the judgment given in the Bulldozer Justice case, the Supreme Court admitted that the demolition of the houses of the accused over alleged offenses bypasses legal processes, violates the rule of law and violates the fundamental right to shelter under Article 21 of the Constitution.

CJI mentioned the historical decisions of the Supreme Court

He said that it was also believed that the executive could not play another role. Mauritius President Dharambir Gokhul, Prime Minister Naveen Chandra Ramgulam and Chief Justice Rehana Mungali Gulbul were also present on the occasion. In his address, the Chief Justice mentioned various historical decisions of the Supreme Court including the 1973 Keshavanand Bharti case.

Justice Gawai said that in the social sector, laws have been enacted to prevent historical injustice and marginalized communities have often resorted to the language of their rule and law to claim their rights.

Chief Justice mentioned triple talaq

He said, “In the political field, the rule of law serves as a standard of good governance and social progress, which is completely opposite to misrule and anarchy.” Referring to Mahatma Gandhi and BR Ambedkar’s contribution, he said that his foresight showed that the rule of law in India is not just a group of rules.

He mentioned recent notable decisions, including the decision to end the practice of triple talaq among Muslims. Justice Gawai also emphasized the importance of the decision in which the right to privacy is considered a fundamental right.
