<p style="text-align: justify;">The Delhi High Court, while granting anticipatory bail to a person posted in the Indian Army in an important case, said that a long-term relationship and the subsequent ritual like roka engagement makes the case of the accused prima facie strong. </p>
<p style="text-align: justify;">According to the records before the court, there was a relationship between the accused and the complainant woman for about five years. During this period, there was a physical relationship between the two for about two years. The court said that during such a long relationship, being stopped with the consent of both the families indicates that there was an intention of marriage at that time.</p>
<h3 style="text-align: justify;">What did Delhi High Court say?</h3>
<p style="text-align: justify;">Delhi High Court said that in a private conversation between the two, the woman herself had admitted that she loved the accused. On this basis, the court said that there could be a possibility that the physical relationship between the two was not based only on the promise of marriage but was based on mutual consent. </p>
<h3 style="text-align: justify;">This is the whole matter </h3>
<p style="text-align: justify;">According to the petition filed in Delhi High Court, the relationship between the two started in the year 2021. Later, the accused talked about marriage with the woman&#8217;s family and with the consent of both the families, the marriage date was fixed. However, the woman alleges that later the accused and his sister demanded dowry of Rs 10 lakh for the marriage. </p>
<p style="text-align: justify;">After this she came to know that the accused was going to get married somewhere else. The woman also alleges that the accused threatened to leak her personal photos and videos and also assaulted her. The woman lodged a complaint with the police saying that the accused had physical relations with her on the pretext of marriage. </p>
<h3 style="text-align: justify;">The trial court will decide the entire matter </h3>
<p style="text-align: justify;">Delhi High Court said that rape was not alleged in the initial police complaint. Looking at all the facts, the court said that the accused has no criminal record and the final decision on the truth of the case will be taken during the trial. Therefore, at present he is given anticipatory bail and has been directed to join the investigation.</p>

The bench of Justice Nagarathna and Justice Ujjwal Bhuyan in a case in which a person is accused of having a physical relationship by making a false promise of marriage. The accused is said to be already married and later he married another woman. It is alleged that the accused had relations with the woman several times in Delhi and later in Dubai by promising her marriage. The woman claims that even private videos were recorded without her consent and she was threatened to make them viral if she protested. Later the woman came to know that the accused was already married and in January 2024 he got married for the second time in Punjab. The lower court and the Delhi High Court have rejected the bail plea of ​​the accused, after which the accused filed a special leave petition in the Supreme Court.</p>
<p style="text-align: justify;"><strong>What was the court&#8217;s comment?</strong></p>
<p style="text-align: justify;">During the hearing, the court also raised questions as to why the complainant went to Dubai with the accused. When told that both were planning to get married, Justice Nagarathna said that if the woman was serious about marriage then he should not have gone with her before the marriage. The bench also said that it is possible that he may have old views, but it is not appropriate to trust someone completely before marriage. The court indicated that this case appears to be a consensual relationship and in such cases the possibility of a settlement can be considered instead of a lengthy trial. A date has been fixed for the next hearing of the case.</p>
<p style="text-align: justify;"><strong>Is having sex before marriage a crime?</strong></p>
<p style="text-align: justify;">Merely having consensual sex before marriage is not considered a crime in itself. However, if it is proved that the relationship was established under false promises, deception, pressure or concealment of identity, then the case can be criminal. Under Section 69 of the Indian Judicial Code, if a person enters into a physical relationship by making a false promise of marriage and the allegation is proved, then he can be punished with imprisonment of up to 10 years and fine. This provision also includes relationships created by giving job, promotion or other false inducements.</p>

It will entirely depend on the wish of the customer whether he wants to pay the service charge or not, the court has considered the guidelines of the Central Consumer Protection Authority (CCPA) correct.  It is clearly stated in these guidelines that service charge cannot be automatically added to the bill. It is wrong to call service charge essential or necessary. No additional charges can be forcibly imposed on the customer. Apart from this, the Ministry of Consumer Affairs, Food &#038; Public Distribution has also made it clear that forcibly collecting service charges is a violation of consumer laws. </p>

<p style="text-align: justify;">If a restaurant violates the rules and forcibly charges service charges, action can be taken against it. In such cases, a fine of up to Rs 50,000 can be imposed. If necessary, other legal steps can also be taken. </p>
<p style="text-align: justify;"><strong>What to do if service charge is forcibly added to the bill?</strong></p>
<p style="text-align: justify;">If a restaurant has automatically added service charge to your bill, you can ask for correction in the bill. You can clearly say that you do not want to pay service charge. Retain the right to remove additional charges. If despite this the restaurant still tries to take money, you can complain about it. </p>
<p style="text-align: justify;"><strong>Where and how to complain?</strong></p>
<p style="text-align: justify;">You can lodge a complaint on the National Consumer Helpline. You can file a case in the Consumer Commission (Consumer Court). Complaint can also be filed through online portal. While making a complaint, keep a copy of the bill and proof of payment. </p>
