<p>An important news related to the Delhi riots case of 2020 has come to light. The Supreme Court has rejected the bail plea of ​​Umar Khalid and Sharjeel Imam, accused in this case. In the Delhi riot case, the police allege that Umar Khalid gave inflammatory speeches before the violence and was a part of the conspiracy. <p><strong>Omar Khalid&#8217;s education</strong></p>
<p>Umar Khalid is considered good in studies. Omar has achieved higher education in history. While staying in JNU, he became very active in student politics. Along with studies, his opinions on social and political issues were often discussed.</p>
<p><strong>Sharjeel Imam&#8217;s journey</strong></p>
<p>Sharjeel Imam&#8217;s name is also included among the main accused in this case. Sharjeel Imam started his educational journey from science. Earned B.Tech and M.Tech degrees in Computer Engineering from IIT Bombay. After this, he took interest in subjects like history and politics and started doing PhD in Modern History from JNU. Due to some speeches given before the Delhi riots, Sharjeel Imam was also accused of inciting violence. The court has also rejected his bail plea.</p>
<p><strong>Gulfisha Fatima got relief</strong></p>
<p>Gulfisha Fatima has got conditional bail in this case. Gulfisha has been an educated student and social worker. Who has done MBA from an institute in Ghaziabad and has studied MA in Urdu from Delhi University. Gulfisha also received training as a radio jockey and wanted to become a teacher in future. He played an active role in the movements against the citizenship law. In the year 2020, he was arrested in the Delhi riots case.</p>
<p><strong>Meeran Haider and others</strong></p>
<p>Meeran Haider has been a PhD student of Jamia Millia Islamia. Who was arrested by the Special Cell of Delhi Police in April 2020. Police alleged that he was involved in the conspiracy of riots. Now he has got conditional bail from the Supreme Court. Similarly, some other accused including Shifa ur Rehman have also been given relief, but they will have to strictly follow the bail conditions.</p>

These people had also argued that they had been in jail for more than 5 years. The bench of Justices Arvind Kumar and NV Anjaria has considered their role in the riots to be lesser than that of Sharjeel and Omar. On this basis he has been given concession.</p>
<p style="text-align: justify;"><strong>The conditions of UAPA were taken care of</strong><br />Apart from laws like IPC Arms Act, sections of UAPA (Unlawful Activities Prohibition Act) have also been imposed on all these accused. All the accused had sought bail on the basis of Article 21 of the Constitution (Right to Life and Liberty). The court released 5 people without trial on the grounds that they had been in jail for a long time. But in the case of Umar and Sharjeel, Section 43D(5) of UAPA was applied.</p>
<p style="text-align: justify;"><strong>&#8216;Ask for bail after 1 year&#8217;</strong><br />The Supreme Court has asked Delhi Police to conduct the case expeditiously in the lower court. The court has also said that after the examination of the main witnesses of the case, Sharjeel and Umar Khalid can file a bail application. If there is a delay in this, then after one year of this order both can demand bail from the trial court.</p>
<p style="text-align: justify;"><strong>What is the matter?</strong><br />In February 2020, 53 people were killed and hundreds were injured in clashes over anti-Citizenship Amendment Act (CAA) protests. It is alleged that these accused had conspired to instigate riots. Delhi Police has registered an FIR against them under sections of the IPC like rioting, illegal assembly, criminal conspiracy, and also under the Unlawful Activities (Prevention) Act (UAPA). Multiple FIRs are registered against most of the accused. Delhi Police has also argued that the attempt of the accused was to affect the integrity of the nation by spreading violence across the country.</p>

Citing Section 43D(5), the court said that while considering bail, it is seen whether the material of the prosecution makes out a prima facie offense or not.</p>
<p style="text-align: justify;">The court also made it clear that &#8216;terrorist acts&#8217; are not limited to violence only. Rather, a conspiracy to harm the country&#8217;s system, essential services and economy also comes under its purview.</p>
<h3 style="text-align: justify;">Khalid was accused of inflammatory speech in Delhi riots</h3>
<p style="text-align: justify;">Umar Khalid and Sharjeel Imam are accused of giving inflammatory speeches, conspiring and playing a role in spreading violence during the 2020 Delhi riots. Investigating agencies claim that these activities posed a threat to the unity and security of the country. <p style="text-align: justify;"><strong>Delhi news:</strong> The bail plea of ​​Khalid Saifi, accused in the &#8216;conspiracy&#8217; case of 2020 Delhi riots, was strongly debated. Senior advocate Rebecca John appeared in the High Court on behalf of Khalid. He said that protesting in democracy cannot be terrorism. Justice Naveen Chawla and Shalinder Kaur were hearing on bail.</p>
<p style="text-align: justify;">Rebecca John said, &#8220;If I join any performance in places like Jantar Mantar or Gandhi Peace Foundation, does it mean that I am plotting.&#8221; He said that it is the right of every citizen to protest and it is against the basic principles of justice to present it as a crime.</p>
<p style="text-align: justify;"><strong>Khalid Saifi&#8217;s strong debate on bail</strong></p>
<p style="text-align: justify;">Rebecca John argued that no weapon was recovered from Khalid Saifi. No illegal funding was found. Nevertheless, he has been kept in jail for five years. He raised the question that when the Delhi Police did not find any concrete evidence against Khalid, then why delay in granting bail. The court was told that Khalid Saifi was on a wheelchair in the first appearance. He had plaster on his body. Rebecca John said that wheelchair and plaster shows what happened in custody with Khalid Saifi. Is it not enough to shock the court conscience?</p>
<p style="text-align: justify;"><strong>&#8216;Is it a crime to disagree with the government?&#8217;</strong></p>
<p style="text-align: justify;">Khalid Saifi&#8217;s lawyer said that if a WhatsApp chat or conversation is with the prosecution, it should be proved in the case. But it is not right to keep someone in jail for years by applying UAPA. He questioned whether it has now become a crime to disagree with the government in democracy. Explain that the High Court is hearing the bail petitions of other accused including Umar Khalid, Shajil Imam, Mohammad Salim Khan, Shifa-ur-Rehman, Shadab Ahmed, Atar Khan, Khalid Saifi and Gulfisha Fatima in the Delhi riot case. The next hearing will be held on 16 April. </p>
