<p style="text-align: justify;"><strong>Can discrimination be done on the basis of religion?</strong></p>
<p style="text-align: justify;">First of all, we come, Medical Council of India (Now NMC )&#8217;s Code of Medical Ethics Regulation, 2002, in which medical ethics is told. According to this, a doctor should not ignore any valid patient. If a doctor deliberately refuses to treat without giving any concrete reason, then this rule is considered a violation.</p>
<p style="text-align: justify;">A research report published in PMC Medical Negligence: Indian Legal Perspective states that if a doctor is very negligent, such as not deliberately not seeing or leaving the patient, then it comes under the purview of legal action. Earlier, Section 304A (Rash or Negligent Act Causing Death) of the IPC, which has now turned to Section 106 (1) of the Code of Justice of India (BNS). If someone dies due to negligence in this, then there can be punishment. But this applies only when negligence is serious. Apart from this, the patient also has the right to prosecute a civil law in the medical field.</p>
<p style="text-align: justify;"><strong>Right to refuse treatment</strong></p>
<p style="text-align: justify;">The patient has the right to informed consent. This means that the patient should be given complete information before treatment. According to this, the doctor also has the right to understand that the patient&#8217;s case is risky for him or is not a resource, then he can refuse to treat, or refer the matter. But the biggest thing in this is that refusal on the basis of religious, caste or gender is considered illegal and immoral. The patient can file a case in the court for this and the doctor can also be punished. However, it is necessary that there is evidence in the case that the doctor deliberately discriminated or negligence.</p>
