DHS List: The US Department of Homeland Security (DHS) has recently launched a database called ‘Worst of the Worst’ (WOW). This includes the names of 25,000 criminal illegal aliens i.e. criminals living in America illegally. These criminals include people who commit serious crimes like murder, sexual crimes and drug trafficking. 89 people of Indian origin are also included in this list.

According to DHS this database is publicly available. In this, the names, photographs, information about their crimes and nationality of the arrested people are given. DHS said in a social media post that through this website (WOW.DHS.GOV), ordinary Americans can see which criminals were living in the country illegally, for which crime they were arrested and from which community they were removed.

DHS issued statement

DHS said this is only a snapshot, meaning a portion of the criminals removed from the streets under the Trump administration. The department said, ‘These are the same criminals who created terror in our community. We will not stop until every criminal is removed from the country. American citizens should not fall victim to those who do not have the right to live here legally.

Trump administration had launched a campaign

During his election campaign, US President Donald Trump had promised to take strict action against immigrants without valid documents in America. At the beginning of his second term, he issued many orders. These included declaring a national emergency on America’s southern border and deploying additional troops there. Besides, he also pledged to flush out the criminals present in the country.

Violent incidents took place in many states during this process, which increased resentment among Democrats and some Republican leaders. Currently, Democrats in the Senate have blocked the DHS budget and are demanding reforms to the ICE and CBP agencies. These demands also include making it mandatory for officers to wear body cameras and IDs. The administration also made it clear that there will be no change in the order for agents to wear masks.

The US Department of Homeland Security (DHS) reported on January 5 that two truck drivers in the state of Indiana have been arrested for smuggling more than 300 pounds of cocaine inside a semi-truck. DHS said both men are from India and were arrested after 309 pounds of cocaine was found during an inspection of the truck.

According to the Department of Immigration and Customs Enforcement, on January 4, local authorities in Putnam County, Indiana, arrested 25-year-old Gurpreet Singh and 30-year-old Jasvir Singh. The DHS release said that just a 1.2 gram dose of dangerous cocaine could kill more than 1,13,000 Americans.

Driving licenses were issued in California
DHS said both men were issued driver’s licenses in California. Assistant Secretary of State Tricia McLaughlin criticized Gavin Newsom for granting driver’s licenses to these individuals, calling his policies reckless. DHS quoted McLaughlin as saying, ‘Gavin Newsom and his refugee policy supporters also refused to comply with the arrest notice issued in December against one of these criminal illegal immigrants. He also said that Gavin’s refugee policies are putting the lives of American citizens in danger.

‘Both accused had entered America illegally’
Gurpreet Singh had entered the US illegally on March 11, 2023, near Lukeville, Arizona. He was later released during the Biden administration. According to DHS, Gurpreet himself admitted that he is an Indian citizen and had entered the US illegally. Jasvir Singh also entered America from Otay Mesa, California on March 21, 2017. He was arrested by secretary Tricia McLaughlin.

This time, an important immigration policy of the Trump administration, the $1,00,000 fee increase on H-1B visas, is going to be challenged in court by 19 states. These include California, New York, Illinois and other states.

Lawsuit over H-1B visa fee increase
California and other states have filed lawsuits against the Trump administration. The H-1B program allows US employers to hire foreign workers for specialized occupations, as described by the US Department of Labor.

California Attorney General Rob Banta wrote on Twitter that Trump’s illegal new $100,000 H-1B visa fee could hinder the recruitment of teachers, physicians, researchers, nurses and other critical workers and jeopardize California’s ability to provide essential services. According to a press release from Banta’s office, this new fee could pose a costly barrier to employers, especially public and government institutions, who are trying to fill these positions.

When and where will the case be filed
According to Reuters report, this lawsuit will be filed on Friday (local time) and will be presented in the Federal Court of Massachusetts. This will be at least the third legal challenge. Earlier this increased fee was challenged by the US Chamber of Commerce and a coalition of unions, employers and religious groups.

What is this policy?
According to Banta’s office, the lawsuit states that this policy, implemented by the Department of Homeland Security (DHS), is a clear violation of the law. This is because it imposes burdensome fees outside the limits authorized by Congress, goes against the intent of Congress in establishing the H-1B program, bypasses essential rulemaking processes, and exceeds the power granted to the executive branch under the Administrative Procedure Act (APA).

Generally, the H-1B visa fee is set by DHS under the APA’s notice and comment process and is limited to the amount necessary to carry out the agency’s work. The lawsuit says that while an employer typically pays fees ranging from $960 to $7,595 when filing an initial H-1B petition, the new increased fee far exceeds the actual cost.

Banta’s statement
“No president can arbitrarily destabilize our schools, hospitals and universities, and no president can ignore Congress, the Constitution or the law,” Banta said at a press conference on Friday.

The states also alleged that the increased fees were issued without the notice-and-comment process required by the APA and did not fully consider the impacts, particularly on the delivery of critical services by government and non-profit entities.

State filing suit
Besides California, the other states are: Massachusetts, Arizona, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maryland, Michigan, Minnesota, Nevada, North Carolina, New Jersey, New York, Oregon, Rhode Island, Vermont, Washington, and Wisconsin. Attorneys General of California Rob Banta and Joey Campbell of Massachusetts are leading attorneys general of other states in filing the lawsuit.
