The US Supreme Court may give its verdict on Thursday (November 6, 2025) amid the turmoil in the global business world with US President Donald Trump’s announcement of tariffs. In Wednesday’s hearing, judges raised questions about Trump’s legal authority over the tariffs. This stance of the court is not seen in support of Trump. On the other hand, the eyes of the whole world are fixed on this decision.

On November 5, the last hearing in this case started in the Supreme Court, in which most of the judges raised questions on Trump’s decision. Earlier, a lower federal court had ruled regarding the tariffs that Trump did not have the legal authority to impose tariffs on imports from many of America’s trading partners and to impose fentanyl tariffs on products from Canada, China and Mexico. After the lower court’s decision, Trump approached the Supreme Court.

Trump’s tariff policy has been challenged by small businessmen and a group of 12 states and three lawsuits have been filed regarding it. The basis in the petitions has been that before imposing the tariff, Trump did not think about its impact nor did he try to understand the situation. It has been said in the petition that Trump neither held any official meeting with the administration nor was any report prepared in this regard. Trump has to prove in the Supreme Court whether the decisions taken by him are logical and constitutionally correct or not.

According to the report of news agency IANS, the debate regarding tariff went on in the court for more than two and a half hours. The court raised questions on the Trump government’s decision on tariffs. Justice Sonia Sotomayor said, ‘You say that tariffs are not taxes, but in reality they are taxes. They are earning money, revenue from American citizens.

On this, Solicitor General John Sawyer said, ‘I cannot say much about this, it is a regulatory tariff, not a tax. It is true that tariffs increase revenue and this is only accidental. Apart from this, Justice John Roberts said, ‘Correct me if I am not right, but this argument is being given for the power to impose tariffs on any product of any country, in any quantity, for any period.’

Following Justice Roberts’ comments, US Solicitor General D. John Sawyer argued that IEEPA allows the President to regulate imports during a state of emergency. Justice Amy Coney Barrett did not agree with the arguments of the US Solicitor General. He asked Sawyer, ‘Can you cite any other place in the Code or any other time in history where the phrase regulating imports was used to give authority to impose a tariff?’

Additionally, Justice Barrett said that if Congress wanted to approve any limits on emergency tariffs in the future, it would need a two-thirds majority to override the President’s veto. Justice Barrett asked, ‘If Congress says, hey, we don’t like this, this gives the President too much authority under IEEPA, then he’s going to have a very difficult time taking that tariff power away from IEEPA, right? Although the court has not yet announced its final decision in the matter, the US Supreme Court has raised questions on the US President’s decision on tariffs.

US President Donald Trump has affected the economies of many countries through the tariff bomb. Its effect has been seen in India also. In this investigation, not only the finished medicines but also the raw materials (API) used in their manufacturing were included. However, after investigation, the Commerce Department recommended limiting this scope, because many experts believed that imposing tariffs on generic drugs would increase drug prices in the US and could also lead to market shortages. One group wanted to bring production back to America by imposing high tariffs on drugs from foreign countries, while the other group believed that such a step would be harmful to the American people.

John Meersaheimmer also recently cited a German newspaper report, claiming that the US President tried unsuccessfully to contact Prime Minister Narendra Modi on four different occasions. He said, ‘Indians are very angry with us, almost completely. Trump tried to call PM Modi four times and he refused to talk. Apart from this, India is going close to China and Russia. Due to Donald Trump’s tariff policies and global uncertainties, the speed of the US and the world economy has been braked. The Economic Cooperation and Development Organization (OECD) in its latest report has cut the growth rate of Global Economy, including the US.

America’s growth decreased from 2.2 per cent to 1.6 per cent

According to OECD, the US economy will now grow at a rate of only 1.6 per cent in 2025, while in March 2025 it was 2.2 per cent. For 2026, this rate has been reduced to 1.5 percent. The report states that business policies in the US, strict immigration rules, cuts in the number of government employees and tariffs have a direct impact on investment and consumption.

Global growth also downgrade

OECD has also reduced the global economic growth rate. Now global growth is estimated to be 2.9 percent for both 2025 and 2026 years, which was 3.1 percent and 3 percent earlier. This decline is especially seen in the US, Canada and Mexico. There is a relatively mild effect in the rest of the countries.

“Tariff policy became the reason for economic uncertainty”

The report said that the new tariffs, consumers and business sectors, implemented in the US since May 2025, are weakening the confidence. Recently some tariff rules were stopped in the US court, but they were restored again. The Trump administration is now planning to increase the tariff to 50 per cent on steel.

OECD Chief Economist Alvaro Perera said in an interview to CNBC, “Almost every country had to decrease the growth of every country because uncertainty about trade and policies has now reached a historical level.”

Not only growth, now inflation is also emerging as a big threat. According to OECD, inflation in the US can be 3.2 percent in 2025, which was earlier 2.8 percent estimated. By the end of the year, this figure can reach 4 percent. The main reason for this is the increase in the cost of goods due to tariff on imports. However, to some extent, the decline in commodity prices can provide relief.

In this disappointing economic scenario, technology is being seen as a possible positive factor. OECD believes that areas like AI, Robotics and Quantum Computing in the US are progressing rapidly.
