Taking a historic decision in 2018, the Supreme Court had abolished this section, after which if two people make a relationship with mutual consent, then it is not considered a crime. In the Indian Code, which was implemented in 2024, it was not classified as a crime for mutual consent outside the marriage.

It is worth noting here that even if the relationship with someone else is not a crime after marriage, but it can be the basis of divorce. If a woman or a man has an illicit relationship despite being married, then his partner can go to court on the basis and demand divorce.
