This new rule has come into effect from today i.e. 15 December 2025. Earlier this scrutiny was done only for F, M and J visas of students and exchange visitors, now it has been extended to H-1B i.e. skilled workers and H-4 visas of their family members also.</p>
<p style="text-align: justify;"> <strong>Social media account will have to be made public</strong></p>
<p style="text-align: justify;">According to the State Department, the purpose of this investigation is to strengthen national security. Every visa application will now be viewed from the perspective of national security. Applicants have been asked to make &#8216;public&#8217; the privacy settings of all their social media accounts (like Facebook, Instagram, Twitter, LinkedIn etc.) so that the officials can easily check. If the profile remains private or any online activity appears suspicious, the visa may be delayed or even denied.</p>
<p style="text-align: justify;"><strong>Appointments of visa applicants in India canceled</strong></p>
<p style="text-align: justify;">Due to this new rule, many H-1B and H-4 visa interview dates have been canceled in India. Many December appointments have now been shifted to March 2026. This effect is being seen especially in American embassies like Hyderabad and Chennai. This is affecting thousands of Indian tech professionals and their families, as most of the H-1B visa applications come from India.</p>
<p style="text-align: justify;"><strong>Visa of Indians in America canceled</strong></p>
<p style="text-align: justify;">Some H-1B and H-4 visa holders living in the US have received emails that their visas have been &#8216;prudential revocation&#8217;. This usually happens when old legal cases (even if there was no conviction) are re-examined. According to immigration experts, this cancellation does not affect the legal stay in the US, but there will be re-checking the next time at the time of visa stamping.</p>

While earlier a mandatory fee of $100,000 (about Rs 83 lakh) was proposed, now the administration is preparing to further tighten the rules related to visa eligibility, usage and responsibilities of employers.</p>
<p style="text-align: justify;">This proposal is included in the new regulatory agenda of the US Department of Homeland Security (DHS). It has been included in the Federal Register under the H-1B Non-Immigrant Visa Classification Program Improvement. The purpose of the new rules is to prevent misuse of visas, hold employers accountable and protect the rights of American workers.</p>

On Thursday, September 25, TCS shares came close to 52-weeks low level. Indian IT companies are in bad shape due to new rules regarding H-1B visa from President Donald Trump in America. The market cap of these companies has lost about 2 lakh crores.</p>
<h3 style="text-align: justify;">TCS shares fall drastically </h3>
<p style="text-align: justify;">Last year, on 13 December, TCS shares reached a record high level of Rs 4,494. Since then, it has declined by 35 percent. In the last few days, it has been the worst performance share on the Nifty IT index. Alam is that the TCS is reaching close to the oversold zone on the chart, whose relative strength index (RSI) is at the level of 32. RSI reading below 30 means that the share is in the &#8216;oversold&#8217; zone. After TCS, HCLTECH shares have fallen by 27 percent so far. </p>
<h3 style="text-align: justify;">Shares of these companies also fell</h3>
<p style="text-align: justify;">According to the Economic Times report, in the last 11 months, TCS shares have declined by 29 percent and it is still going on. This has caused a loss of Rs 4.5 lakh crore to the company&#8217;s market cap. TCS&#8217;s market cap was Rs 10,70,013 crore till Thursday, 25 September. Despite such a big decline, it still remains on its position of the country&#8217;s largest IT company. After TCS, the shares of Persistant Systems and HCL Tech have fallen by about 2 percent, while Wipro and Coforge&#8217;s shares have declined by more than 1 percent. The shares of Infosys, Emphasis and Tech Mahindra have also declined by about 1 percent, while LTIIMINTRI shares were trading on the red mark with a slight decline. </p>
<h3 style="text-align: justify;">What is Trump&#8217;s new decree? </h3>
<p style="text-align: justify;">Trump recently increased the fees for H-1B visa to $ 100,000. Last year, most H-1B visas were issued by American companies to Indians. India alone was 71 percent in the Total Issured H-1B visa, while China stood at 11.7 second place. Trump&#8217;s maximum impact has been affected by Trump&#8217;s increase in H-1B visa fees because the US market is very important for Indian IT companies.</p>
<p style="text-align: justify;">Now, due to increase in fees, the expenditure being incurred on clients in the US IT market may decrease. This can increase the cost of Indian companies. With the increase in fees, Trump has also proposed to eliminate the lottery system for allotment of H-1B visa and suggested to replace it with a wedge-based selection process. That is, while issuing the visa, priority will be given to those foreign workers who will apply more salary employees. </p>

The number of H-1B visas issued from India in 2015 was 14, 792, which declined to 10,162 in 2024. Nascom says that the new fees will only apply to new applications and it will not affect the existing visa holders. According to Nascom, the number of H-1B visa employees is less than one percent of the total employees in large companies.  The salary of employees working under this visa is equal to local employees. </p>

This visa is for employees who are already working in the company and want to be transferred to America. This visa is released for professionals with extraordinary talent. At the same time, J-1 visa is also available for jobs in America, this visa is for trainee and intern. Apart from this, you can also work in America with EB-1A visa. This visa also gives a green card directly to professionals with extraordinary talent. At the same time, students who have completed their studies in America are also allowed to work for 3 years under Stem OPT. </p>

<p style="text-align: justify;">H-1B visa fees can affect the entry level jobs. At the same time, after changes in visa, companies will now give priority to local or American graduates.
