• In such a situation, their marriage is not considered valid under the Hindu Marriage Act. That is why Hema Malini will not get a share in Dharmendra’s property.
• Only if the court accepts Dharmendra’s marriage as valid or if Dharmendra gives a share in his property to Hema Malini in his will, then only the actress will be able to claim a share in his property.

How much share will Esha Deol and Ahana get?
Dharmendra and Hema Malini have two daughters – Esha Deol and Ahana Deol. In such a situation, the question is that if Hema Malini is not a sharer in Dharmendra’s property, then won’t his two daughters also get a share in their father’s property? On this, Advocate Kamlesh Kumar Mishra said- ‘The Supreme Court has made it clear that children born out of invalid marriage will now get a share in the property not just by name but by legal rights. Esha and Ahana Deol are equally entitled to their father’s share in the entire property. That means Isha and Ahana will get equal share in Dharmendra’s property as Sunny Deol and Bobby Deol.

Advocate Kamlesh Kumar Mishra said- ‘The 2023 decision of the Supreme Court has clearly explained how children born out of an invalid marriage can be entitled to a share in the ancestral or coparcenary property of the parents. It specifically harmonizes Section 16(3) of the HMA and Section 6(3) of the Hindu Succession Act (HSA).’
