<p style="text-align: justify;">Rajya Sabha MP Harish Biran sought information regarding vacant posts in High Courts across the country. It was asked what are the existing vacant posts of judges in the High Courts, the details of the recommendations of the Supreme Court Collegium pending before the government and the reasons for their pending. Apart from this, has the government evaluated the impact of vacancies on pending cases in the country? If yes, what are its details? And what are the steps taken by the government to fill these vacancies in various courts?</p>
<p style="text-align: justify;"><strong>Answer given by the government</strong></p>
<ol>
<li style="text-align: justify;">Responding to this, Minister of State (Independent Charge) of the Ministry of Law and Justice and Minister of State in the Ministry of Parliamentary Affairs, Arjun Ram Meghwal said that against the sanctioned posts of 1122 judges till 27 November 2025, 825 judges are working and the posts of 297 judges are vacant in various High Courts. </li>
<li style="text-align: justify;">Against these vacancies, 97 proposals for appointment of High Court judges are at various stages between the government and the Supreme Court Collegium. Recommendations for 200 vacancies have not yet been received from the High Court Collegium.</li>
<li style="text-align: justify;">Giving information, the Minister said that the responsibility of initiating proposals for appointment of judges in the Supreme Court rests with the Chief Justice of India, whereas the responsibility for initiating proposals for appointment of judges in the High Courts rests with the Chief Justice of the High Court.</li>
<li style="text-align: justify;">As per MOP, High Courts have to make recommendations at least 06 months before the vacancy. However, this time limit is rarely observed. For appointments to High Courts, the opinion of the concerned State Government is obtained as per MOP. The recommendations are also to be considered in the light of other reports available for discussion. The recommendations of the High Court Collegium, State Governments and the Government of India are then sent to the Supreme Court Collegium (SCC) for advice.</li>
<li style="text-align: justify;">The appointment of judges to high courts is a continuous, integrated and collaborative process that requires consultation and approval between the executive and the judiciary. It requires consultation and approval from various constitutional authorities at the state and central levels. Only those persons are appointed as judges of the High Courts whose names have been recommended by the SCC. From May 2014 to 01.12.2025, 1156 judges have been appointed in various High Courts.</li>
<li style="text-align: justify;">Pendency of cases in the Court arises due to several factors, including complexity of facts, nature of evidence, cooperation of stakeholders, such as the Bar, investigating agencies, witnesses and litigants, as well as physical infrastructure, supporting court staff and proper application of rules and procedures to track and bunch hearing of cases. Moreover, the pendency of cases in the High Courts and the vacancy position of judges are not necessarily directly related.</li>

<p style="text-align: justify;">In the last few years, it happened many times that some judges of the Supreme Court or High Court recused themselves from a case. Sometimes reasons are given, sometimes not, but the question arises that how can a judge recuse himself from a case and what difference does it make to his career? </p>
<p style="text-align: justify;"><strong>How can a judge recuse himself from a case?</strong></p>
<p style="text-align: justify;">This is called Recusal in English i.e. withdrawing oneself from the hearing of a case. The main reason for this is conflict of interest. Meaning, any relationship, background or association that people feel could influence the judge&#8217;s decision. As if the judge is from the same state where the case is related to. There may be a past acquaintance or professional relationship with any party, the judge may have previously been an advocate in the same case, the judge may have shares or interests in any organization related to that case. </p>
<p style="text-align: justify;"><strong>Does the judge have to give reasons?</strong><br />There is no fixed rule that the judge has to be told why he is stepping aside. Sometimes the judge himself gives the reason, sometimes he silently withdraws without giving any reason, it completely depends on the judge. However, there are some ethical guidelines. For example, if a judge has shares in a company, he cannot hear cases of the same company. Apart from this, if the judge has previously been a lawyer in a case, then he should withdraw from that case. </p>
<p style="text-align: justify;"><strong>What happens to the case if the judge withdraws?</strong></p>
<p style="text-align: justify;">The case is given to another judge or a new bench. Who to give is decided by the Chief Justice in the High Court and the CJI in the Supreme Court. Sometimes a judge is changed and sometimes the entire bench is changed. Whereas the judge recusing from the case is a normal process. This is considered sensible and moral. Many times this step increases the credibility of the judiciary. It is clear from this that for the purpose of justice, a judge&#8217;s withdrawal from a particular hearing or case does not affect his career in any way. </p>

<p style="text-align: justify;">To become a lawyer in the Supreme Court, after studying law, you have to appear for an important examination. Which is AIBE, this examination is conducted by the Bar Council of India to ensure whether a new lawyer is eligible to practice in the court or not, whereas if you want to become a lawyer in the Supreme Court, then it is necessary to work in the District Court and High Court first. Apart from this, to practice independently in the Supreme Court, you have to pass the Advocate on Record (AOR) examination.  </p>
<p style="text-align: justify;">Only after passing this examination, you can file a case in your name in the Supreme Court. There are some conditions for this, such as there should be at least 5 years of court experience, 1 year of training with an AOR lawyer and after passing the examination, your office should be within 10 miles of the Supreme Court. The court said that those who calculate this thing will also have to tell the public.</p>
<p style="text-align: justify;"><strong>Opposition to ethnic census</strong><br />Significantly, the caste census being done by the Karnataka government is being opposed and it is being alleged that it can be taken political advantage. Earlier this week, the state government defended the survey and said that the central government is adopting a double attitude in this matter. The survey, which started from 22 September, will run till October 7. Due to the problems of server and network, employees had a problem with the first two days.</p>
<p><strong>Abhishek Manu Singhvi gave this argument</strong><br />Senior advocate Abhishek Manu Singhvi, appearing for the state, argued that the Center had amended the 105th constitution in 2021, under which the states got the right to identify and list the backward classes. Singhvi said in the court that now the Center is now supporting the petitioners because there is a government of the opposition party in the state.</p>

But instead of finishing this, the court added a unique condition to it. </p>

The court said that if a judge is hearing a criminal case in a day, he cannot expect to decide in 50 cases, but if a judge says that he will hear only one bail plea in a day, then he needs to assess.</p>
<p style="text-align: justify;">According to PTI reports, the bench of Justice Suryakant and Justice N. Kotishwar Singh was hearing the petitions that were filed by some convicts found for life imprisonment and death penalty. He alleged that the Jharkhand High Court has not pronounced the decision on his criminal appeals, despite keeping the faasy safe for years. However, the High Court later ruled in his case and acquitted many convicts.</p>
<p style="text-align: justify;">The Supreme Court said that it does not want to work like a school prince for high courts, but should have a self-mausing system to ensure that he does not have piles of files on the table. The court said, &#8216;There are also judges who work day and night and are disposing of the cases brilliantly, but there are some judges who are unfortunately unable to complete the work. Whatever the reason, good or bad, we do not know and maybe there may be some situations.</p>
<p style="text-align: justify;">The Supreme Court said, &#8216;Suppose a judge is hearing a criminal appeal, so we do not expect him to decide on 50 cases in a day. Deciding on a criminal appeal in a day is a huge achievement in itself, but in the case of bail, if a judge says that I will decide only on a bail plea in a day, then it is a matter for which there is a need to do self -evaluation.</p>
<p style="text-align: justify;">The Supreme Court said, &#8216;Our intention is not to act like a school principal and there should be extensive guidelines, so that the judges know what they have and how much they have to do. There is a legitimate hope of the general public from the judiciary.</p>
<p style="text-align: justify;">Advocate Fauzia Shakeel, who appeared in the case, presented a chart on the position of the decisions given by various High Courts and emphasized that some High Courts have not provided data in the prescribed format. The bench asked him to file the high court figures within two weeks, where the cases were reserved. Also, directed to upload the date of announcement of decisions and the date of uploading them. Senior Advocate Ajit Sinha was asked to assist in the matter.</p>
<p style="text-align: justify;">Justice Suryakant said that some high courts have a habit of unnecessarily postponed cases. He also said that it can be dangerous for the image of the judges, as has happened with some judges in the past.</p>

The court has clearly stated that the examination papers will have to be re-examined. Until the investigation is completed, the new result will not be released. If the investigation is not possible again, then the exam will have to be done again.</p>
<p style="text-align: justify;">A division bench headed by Justice Namwarpu Rajeshwar Rao gave the verdict after a detailed hearing on 7 July 2025. The court has given TGPSC eight months to complete this investigation. Thousands of candidates appearing for Group-1 examination will be affected by this decision, who had been waiting for the result for a long time.</p>
<p style="text-align: justify;"><strong>What is the whole matter?</strong></p>
<p style="text-align: justify;">Telangana Public Service Commission (TGPSC) released the result of Group-1 examinations on 10 March 2025. This examination is for the state government jobs, in which recruitment is done for many big posts. However, after the result, many candidates questioned its investigation process. He said that there has been a disturbance in the investigation of the papers and there are many mistakes in the result. The candidates also said that there was a lack of transparency in the entire process. Some candidates filed a petition in the High Court regarding these complaints.</p>
<p style="text-align: justify;">The petition said that TGPSC did not investigate the papers properly. Candidates also gave some evidence to the court, in which claims of disturbances in evaluation were made. The court heard these petitions seriously. In the hearing held on July 7, the bench of Justice Rajeshwar Rao heard the arguments of all the parties and took stock of the evidence. After this, the court ruled to cancel the ranking list.</p>
<p style="text-align: justify;"><strong>What did the court say?</strong></p>
<p style="text-align: justify;">The court clearly stated in its judgment that TGPSC will have to re-examine Group-1 exam papers. This investigation should be completely transparent and fair. The court has given TGPSC eight months for this. In such a situation, TGPSC will have to complete this process by March 2026.  If for some reason the investigation is not done again, the court has also said that TGPSC will have to conduct a fresh examination. This decision of the court is a big relief for those candidates who were not happy with the result. However, those people who had passed the results had passed before. Now they will have to wait for new results.</p>
