Delhi’s Rouse Avenue Court has framed charges against RJD supremo Lalu Yadav, former Bihar CM Rabri Devi and Tejashwi Yadav in the IRCTC scam case. BJP’s first reaction has come on this decision of the court on Lalu family. BJP spokesperson Pradeep Bhandari said that the people of Bihar will never elect the corrupt RJD and Congress.

The youth of Bihar should be aware of the sinister corrupt intentions of Lalu Yadav and Tejashwi Yadav. The people of Bihar will never elect the corrupt RJD and Congress.

What did the court say in the order?

Rouse Avenue Court admitted that this scam was hatched with the knowledge of Lalu Yadav when he was the Railway Minister. The court said that the accused in this case were also completely involved in the conspiracy. Lalu Yadav’s family benefited in this case and in return for giving the contract, Rabri Devi and Tejashwi Yadav got land at a very low price.

Under which sections was the case registered against Lalu family?

In this case, the court has filed charges against Lalu Yadav family under IPC 420, IPC 120B, Section 13(2) and 13(1)(d) of the Prevention of Corruption Act. Let us tell you that Section 13 (2) and 13 (1) (d) of the Prevention of Corruption Act is applicable only on Lalu Yadav because he has misused his position while holding a government post.

What was IRCTC scam case?

When Lalu Yadav was the Railway Minister between 2004 and 2009, contracts for the maintenance of two IRCTC hotels BNR Ranchi and BNR Puri were given illegally. It is alleged that these contracts were given in exchange for three acres of valuable land acquired through an anonymous company linked to Lalu.

The court has said that there were irregularities in the contract process and the beneficiary company was helped in winning the tender. Instead, the allegation is that properties like land were given to the Lalu family to benefit them in corrupt ways.

What is the matter?

This case is related to the tenders which were issued for the maintenance and operation of two IRCTC hotels located in Ranchi and Puri. It is alleged that these tenders were awarded to a private company named Sujatha Hotels in an irregular manner by misusing political and administrative influence. According to the CBI, in exchange for these tenders, valuable land in Patna was deposited with the Lalu family, which was allegedly transferred at non-market rates. This investigation started in the year 2017 when CBI had registered the FIR in the case and later prepared the chargesheet.

What are the chances of Tejashwi Yadav contesting the elections?

The answer is yes, because right now only charges have been framed against Tejashwi Yadav and not punishment. According to Indian law, he can contest elections unless he is sentenced by a court and if the sentence is two years or more. Section 8 of the Representation of the People Act, 1951, under which a person can be deprived of the right to be elected or contest elections only if he is convicted of a serious crime and sentenced to death.

Therefore, Tejashwi Yadav’s eligibility to contest the elections still remains. However, if the court finds them guilty and imposes the maximum sentence, they may be temporarily or permanently disqualified.
