After the new changes, the army, especially the current Army Chief General Asim Munir, has become very influential. On the contrary, there is a clear cut in the powers of the judiciary. <p style="text-align: justify;" data-start="490" data-end="846">Volker Turk, head of the UN Human Rights Office, warned in a statement issued on Friday that &#8216;these hasty amendments&#8217; in Pakistan seriously affect the independence of the judiciary. According to him, this step increases the possibility of military interference and weakening of the role of the civilian government, which raises serious questions on the rule of law.</p>
<p style="text-align: justify;" data-start="490" data-end="846"><strong>Turk said this big thing</strong></p>
<p style="text-align: justify;" data-start="848" data-end="1207">Turk said that this amendment was implemented without any public discussion, consultation with the legal community or extensive debate, which is contrary to the democratic process. According to him, these changes go against the institutions that protect human rights and the rule of law in Pakistan. In particular, deep concerns have been raised about the impact of these amendments on the independence of judges.</p>
<p style="text-align: justify;" data-start="1209" data-end="1537">The statement said that the new provisions related to appointment and transfer of judges could weaken the structural independence of the judiciary. Due to this, there is a danger of increasing political interference and the judiciary coming under the control of the executive. Volker Turk stressed that the courts should remain completely free from any political pressure in their decisions.</p>
<p style="text-align: justify;" data-start="1539" data-end="1831">He expressed special objection to the 27th Amendment, saying that it gives lifetime protection to the President and the Field Marshal from criminal prosecution and arrest. According to him, this move is against human rights principles and the framework of democratic control and can have far-reaching implications on Pakistan&#8217;s democratic future.</p>

<p><strong>What is the power of CJI?</strong></p>
<p>The Chief Justice of India has got very important powers under the Constitution. He is responsible for deciding the functioning of the Supreme Court and deciding which case will go to which bench. Apart from this, the CJI also plays an important role in the appointment process of judges. Without the opinion and signature of the CJI, the appointment of new judges in the Supreme Court or the High Court is not possible. The CJI also constitutes constitutional benches and decides which cases should be heard immediately and which cases should be heard later. Apart from this, the Chief Justice of India sits in a bench of three judges, due to which the impact of his decisions is more than that of other benches. </p>
<p><strong>Can CJI or any judge be arrested?</strong></p>
<p>According to the law of the Indian Constitution, a judge can be arrested, but not like an ordinary citizen. In fact, to maintain the dignity and independence of the judiciary in India, special provisions and procedures have been made for the arrest of judges. In India, judges have been given legal protection, so that they can deliver justice without any pressure or fear. But if a judge misuses his powers or is found involved in any criminal activity, the law applies to him in the same way. Just like it happens to any other citizen. Just its process is different.</p>

<li><strong>The Judges (Protection) Act, 1985-</strong> This Act gives extra protection to judges in civil and criminal cases.</li>

<li><strong>CrPC Section 77-</strong> If a judge does any work in his judicial capacity and impartially, then it will not be considered a crime.</li>
<p>&#13;</p>
<li><strong>CrPC 345-</strong> Insulting a judge or disrupting court proceedings is considered a crime.</li>
<p>&#13;</p>
<li><strong>The Judges Inquiry Act, 1968-</strong> This Act prescribes the procedure for disciplinary proceedings and investigation against judges of the Supreme Court and High Court.</li>

<p><strong>Cji br gavai on constitution:</strong> Chief Justice BR Gawai said on Wednesday (25 June 2025) that the Constitution of India is supreme and all three organs of democracy work under the Constitution. He said that some people say that Parliament is supreme, but in his opinion the Constitution is paramount. Justice Gawai, who took oath as the 52nd Chief Justice last month, was speaking at his reception in Amravati, his hometown in Amravati, East Maharashtra.</p>
<p>He said that there is always a discussion on which part of democracy is supreme &#8211; executive, legislature or judiciary. He said, &#8220;Although many people say and believe that Parliament is supreme, but according to me the Constitution of India is supreme. All three organs of democracy work under the Constitution. &#8221;</p>
<p><strong>&#8216;Parliament has the power to amend&#8217;- CJI BI Gawai</strong></p>
<p>Referring to the decision passed by the Supreme Court on the basis of the principle of &#8216;original structure&#8217;, Chief Justice Gavai said that Parliament has the power to amend, but it cannot change the original structure of the Constitution. He said that just by passing the order against the government, no judge becomes independent. He said, &#8220;The judge should always remember that it is our duty and we are the patron of the rights and constitutional values ​​and principles of the citizens. We do not only have power, but we have also been put on duty.</p>
<p><strong>What will people say? In what relation did CJI say this</strong></p>
<p>The Chief Justice said that no judge should be directed by what people will say about their decision or what they will feel. He said, &#8220;We have to think independently. What people will say, it cannot be a part of our decision making process. During his address, the Chief Justice cited some of his decisions. Referring to his decision against &#8216;bulldozer justice&#8217;, he said that the right to shelter is supreme.</p>
