In many families these shops are generations old. Whom Dada or Baba had once given on nominal rent. With the passage of time, it becomes a big legal dilemma. In cases that are 40–50 years old, the current owners feel that it is almost impossible to vacate the shop now. </p>
<p style="text-align: justify;">But the recent decision of the Supreme Court has changed this thinking. The court clearly said that mere possession for a long period does not confer ownership rights on the tenant. If the real owner or his heirs prove genuine need. So the law stands with them. <h3 style="text-align: justify;"><strong>This is how you can get your shop vacated</strong></h3>
<p style="text-align: justify;">If Baba had given any shop on rent. But the current owner is his heir. So in such a case, the Supreme Court accepted that the right to property is not limited only to the first generation. If the next generation needs a shop, that too will be considered completely legal.</p>

In such a situation, the court can order the tenant to vacate the shop after seeing the rights of the landlord and accepting his arguments. </p>
<h3 style="text-align: justify;"><strong>Long possession does not give rights</strong></h3>
<p style="text-align: justify;">Recently, in one such case, the tenant argued that he has been running the shop for about 50 years and the upper floors can be used as an option. But the Supreme Court rejected these arguments outright. </p>
<p style="text-align: justify;">The court said that the tenant cannot instruct the owner how to use his property. Besides, issues like electricity connection were also considered unnecessary. The court said that the need is assessed from that date. When the suit was filed and not because of later changed circumstances. </p>
<h3 style="text-align: justify;"><strong>This is the whole process</strong></h3>
<p style="text-align: justify;">To evict a tenant from the shop, it is first necessary to check the rent agreement and ownership documents. If there is a written agreement, check its terms, if not, check the rent receipts. After this decide the valid reason. Such as personal or family business needs, non-payment of rent, misuse or dilapidated condition. </p>
<p style="text-align: justify;">After this, send a legal notice through Makil and give a stipulated time. If the shop is not vacant even after the notice, file an eviction case in the rent control court. After the court order, if necessary, the shop can be vacated through legal process.</p>

<p>The government has implemented the New Rent Agreement 2025, which has brought many major changes for both renters and landlords. According to the new rules, now heavy advance rent of 3 to 6 months will not be charged on residential property. Only 2 months security deposit will be taken from the tenant, whereas for commercial property a maximum of 6 months advance is valid. It will be mandatory to give prior written notice to the landlord for increasing the rent, so that arbitrary increase can be stopped. Eviction will no longer be possible without legal procedure and if the tenant does not pay rent for 3 months, the case can be sent directly to the tribunal. Landlords have also got relief in tax. The limit of TDS on rent has been increased from Rs 2.4 lakh to Rs 6 lakh annually, due to which TDS will not be deducted on excess rental income. The benefit of these protections will be available only when the Rent Agreement is compulsorily registered within two months. Registration can be done online or at the nearest registrar office. Failure to register on time may result in a fine of Rs 5,000. Special rent courts and tribunals have been created for speedy resolution of disputes, with the aim being to settle cases within 60 days. <p style="text-align: justify;"><strong>Satyajit ray ancestral house in bangladesh:</strong> Bangladesh&#8217;s Foreign Ministry confirmed on Thursday, 17 July that the building that is being demolished in Maman Singh has neither related to the famous filmmaker Satyajit Ray nor his grandfather Upendrakishore Rai Chaudhuri. Describing this building as historic, India had offered help in preserving it, but now the Bangladesh government has clarified on the basis of old documents that this property was of Shashikant Acharya Chaudhuri, a local landlord of Maman Singh.</p>
<p style="text-align: justify;"><strong>Zamindar had built building</strong><br />The statement said that this building was built by Zamindar Shashikant Acharya Chaudhuri near his bungalow &#8216;Shashi Lodge&#8217; for his employees. After the end of the zamindari system, this property came under the government and then it was allotted to Bangladesh Shishu Academy. Since then, this building has remained the office of Maman Singh District Shishu Academy. The land is listed as non-agricultural government (special) land and is given to the Shishu Academy on a long-term lease.</p>
<p style="text-align: justify;"><strong>No family or historical relationship</strong><br />Bangladesh&#8217;s Foreign Ministry said that after intensive review of land records, it has been confirmed that this land belongs to the government and it has nothing to do with the Ray family.</p>
<p style="text-align: justify;">Local senior citizens and eminent people of various communities have also confirmed that this house and land have no historical relations with the ancestors of Satyajit Ray. In addition, this building is not listed as archaeological monuments.</p>
<p style="text-align: justify;"><strong>Reference of Harikishore Ray Road</strong><br />The statement also stated that the road in front of the building &#8216;Harikishore Ray Road&#8217;, is named after Harikishore Ray, the great -grandfather of Satyajit Ray, who was the adopting father of his grandfather Upendrakishore. The Ray family had a house on this road at one time, which they sold long ago. A new multi -storey building has now been built at that place.</p>
<p style="text-align: justify;"><strong>Local people also clarified</strong><br />Maman Singh&#8217;s social worker Professor Bimal Kanti Dey informed about the misconception that this house is not from the family. Local poet and writer Farid Ahmed Dulal also confirmed that this building has no relation with Satyajit Ray or his family. All the local citizens unanimously said that the construction of a new building for Shishu Academy is in the interest of children and there should be no delay in work.</p>

<p style="text-align: justify;">The Supreme Court, while hearing a case related to the Bombay High Court, has expressed concern over the delay in the decision in the dispute between the property owners and teachers. A bench of Justice Sanjay Karol and Justice Manoj Mishra has &#8220;requested&#8221; the Chief Justice of the Bombay High Court to review such cases pending there.</p>
<p style="text-align: justify;">The Supreme Court is hearing the appeals against the High Court order related to the dispute on &#8216;per square foot rate&#8217;. This case is related to renting the &#8216;Harchandra House&#8217; in Mumbai by Hindustan Organic Chemicals Limited. The bench said that in some cases the litigants have to wait for years to settle their disputes.</p>
<p style="text-align: justify;">The bench said, &#8216;When it comes to the landlord-owner dispute, it also includes aspect of being deprived of the benefits of one side and the aspect of being denied monetary benefits from the other party&#8217;s ownership. It is the duty of the courts to ensure that they do not have trouble due to them. ” The court said that taking a delay in such disputes means that both sides have to bear the brunt of it.</p>
<p style="text-align: justify;">The bench said, &#8220;In some cases the landlord has to suffer losses due to lack of property, and in other cases, the monetary amount is not received from it. The tenant has to suffer losses because the final decision in the case is directed to pay a large amount in a short time when the final decision comes.&#8221; The apex court said that it is a difficult task for tenants to make requisite arrangements to pay such a huge amount.</p>
<p style="text-align: justify;">The bench said on May 6, &#8220;We request the Chief Justice of the Bombay High Court to ask for a report from the courts concerned about the pending period of landlord-owner disputes.&#8221; The court said that if it is found that there are many other cases like this case, the High Court should take &#8216;appropriate steps&#8217; for their early disposal.</p>
